Cooperating with the Government

This is the sixth in a series of posts inspired by a federal drug conspiracy case targeting a middle aged housewife and three of her children.

Stevie Charlot sat in the U.S. Marshall’s holding cell in the federal courthouse in Lafayette. Tomorrow he would have to testify in front of a federal Grand Jury.

The day after the big bust at the Colomb’s place Stevie Charlot got a phone call telling him to come to the Parish Sheriff’s office in Crowley where he was told to stay away from the Colombs until further notice. That was it.

Three-and-a-half months later a Sheriff’s deputy delivered a federal Grand Jury summons and told Stevie that Brian Hundley wanted to talk to him. Stevie gradually figured out that he was expected to testify that he had purchased drugs from the Colombs the day of the raid. All the details were right there in Hundley’s police report.

Alarmed and infuriated, Stevie called up Assistant U.S. Attorney Brett Grayson and said he wouldn’t be testifying on February 19th. Grayson said that was fine—if Stevie didn’t show the authorities would have him arrested and revoke his parole. By a strange coincidence, Stevie’s parole was set to expire the very day he was being asked to testify before the Grand Jury.

On the advice of a friend, Charlot met with Ann Colomb. Ann told Stevie he had no choice but to testify, but he could protect himself. An hour later, Stevie was talking into attorney Daniel Stanford’s tape recorder.

Stevie told Stanford he and his mother had dropped by the Colomb place the day of the raid to tell “Miss Ann” that his father was being transferred to a hospital in Church Point. The visit lasted only a few seconds and no one got out of the car. Hospital records verify that Stevie’s father was transferred to the Church Point Hospital on October 22nd.

When Stevie Charlot was taken to the courtroom on March 12th, 2002 he was pretty sure what he was supposed to say and tried his best to say it. Unfortunately, Detective Brian Hundley had amended his police report so many times it was hard to know what the story was. Officer Troy Hebert was added to the story late in the game to corroborate Hundley’s account but doesn’t appear in earlier reports. In Stevie’s Grand Jury testimony Hebert doesn’t exist.

Having read Hundley’s report, Stevie knew he was supposed to have approached the Colomb residence on foot with a transmitter hidden inside his sock. He was supposed to have discussed a drug deal with Miss Ann and at some point she had searched him. Hundley’s report explained that transmission was poor so he only caught a few words of dialogue, but Ann distinctly said she would have to call her son Edward because she didn’t know where she kept her drugs.

Instead of asking Edward where he kept the drugs (this could have been done without risk using simple code language) she had her son drive all the way home. Edward then leads Miss Ann and Stevie down the hall to Ann’s bedroom where he locates a little medicine bottle stuffed with crack cocaine in Ann’s panty drawer. No one seems to have asked why Edward would choose such an unsettling hiding place for his drugs or why, if he did, his mother didn’t know about it. When the police raided the home hours later the medicine bottle had disappeared.

With Ann and Stevie at his side, Edward removed the bottle from his mother’s drawer, removed three rocks of crack cocaine, did the deal and returned the bottle to its hiding place. I have run this scenario past a few ex-drug dealers and the response is always the same: “that ain’t hapennin’.” You don’t show a crack addict where you keep your stash.

Stevie then left the Colomb home as quickly as possible, “Because, like I say, Mr. Brian was getting—he was getting worried, you know.”

Even Brett Grayson, the man asking the questions, was confused by this remark. “Yeah, but you wouldn’t know that,” he told Stevie, “You were inside the house.” Of course Stevie knew “Mr. Brian” was getting worried—it was right there in Hundley’s report.

When Brett Grayson asked Stevie if the Colombs suspected he had set them up, Stevie tried to be cooperative. He said that a few days after the raid he ran into Edward Colomb and Miss Ann at Jr.’s Food Mart. “And they was like, ‘Man, we know you set us up, brother. You was the last one who left from the house. Ain’t nobody else came after that. Right after you left, not even five or ten minutes, them people kicked down the door.”

The Colomb residence was raided a few minutes after Stevie and his mother dropped by. But Hundley’s reports clearly indicate that Stevie’s alleged buy occurred several hours before the raid. It’s hard to lie consistently.

Stevie’s parole was revoked even though he had cooperated with the government. Visited by a private investigator a few days after his Grand Jury adventure Stevie was back to his original story: he had never worn a wire and he certainly had never purchased drugs from the Colombs.

It isn’t hard to tell when Stevie Charlot is lying and when he is telling the truth. His truthful statements are consistent, corroborated by others and offered freely; his lies are bizarre, mutually contradictory, and uttered with a gun pressed firmly against his temple.

We are left with a disturbing question: If Stevie Charlot didn’t buy drugs from Ann and Edward Colomb on October 22nd, 2002, what are we to make of Detective Brian Hundley’s police report?

I have to laugh at this. It's good that you have some experts to talk to about this but I have been involved in several drug deals using CIs on the law enforcement side (you know, those liars who make it all up).

Dealers get sloppy and if they deal with a buyer on a regular basis, it's not impossible that they show their stash. Heck, if they were smart, they wouldn't be selling drugs anyways.

Your story is reaching the climax where you claim the police, DA, snitches, and their dogs are all in on a conspiracy to frame innocent people. Do you also think the govt blew up the towers on 9/11?

Think about this. Really think about it. Drug use is so common, why would the cops go to all this trouble and risk jail themselves simply to frame an innocent family?

A very good question. Nickel and dime dealers might lead an addict to their stash, but these were supposed to be $500,000 a week kingpins. I notice you have what I call a wannabeguilty orientation. You instinctively believe the cops and mistrust the defendants. If you are in law enforcement it isn't surprising that you would have a jaundiced view towards dealers--that's understandable. But your experience should have taught you to suspect small town cop testimony as well. Once again, I urge you to keep reading. A federal judge didn't call for a retrial in this case for nothing.

What was the name of that little town in Texas where so many were FRAMED AND LATER PROVEN INNOCENT??? OVER 30 WASN'T IT??? How many were there in the FAKE DRUG deal in Dallas, that WERE FRAMED AND THEN FOUND TO BE INNOCENT??? How about the DA, you know the one with the name of a roach or something? Do you need more? To claim this doesn't happen goes against THE HUNDREDS and HUNDREDS of KNOWN cases WHERE IT HAS BEEN PROVEN! FACT! I hope YOU ARE one of our Brothers with true honor who does do it right and by the book, all though I believe you are wasting valuable resources that could be used against REAL CRIMINALS.

The position you have taken IS EXACTLY what an INNOCENT American is up against. That being that ALL COPS AND COURTS are above suspicion and reproach, UNTIL PROVEN OTHER WISE!! What happen as the HUNDREDS of HUNDREDS of cases where they have been proven to be DIRTY??? Help me end this known failure called the war on drugs, and in doing so bring " PUBLIC TRUST " and honor and respect back to our Brothers and Sisters in uniform, and MAYBE one day even our courts!!!! To deny the realities and facts IS TO INSURE hate and distrust of those YOU HAVE SWORN to protect! If the good guys don't have to follow the laws with no accountability and any means is justifiable. THEN THE BAD GUYS DON'T HAVE TO EITHER AND THEY CAN JUSTIFY FEEDING OFF AMERICANS! JUST LIKE EVERYBODY ELSE DOES!!
Where does it stop??? Lets stand together and take the excuse of drugs being used to justify MANY WRONGS AWAY from BOTH the good guys and the bad guys!!!

Excellent response, BUT I must take issue with one part of it. As the BS in Dallas has proven, this is just not a small town cops issue. There is much evidence of this corruption being not only true but possible "" AND PROBABLE ""in every city in our country!
Our Brothers and Sisters in uniform AND THE AMERICAN PEOPLE have been programmed from birth to adulthood to think of these drug users and dealers AS LESS THAN HUMAN. So any means is justified, after all it's just a druggie!!! The problem is these kids go home from D.A.R.E. where they are taught this crap, and they see there families, mothers and fathers and grandparents WHO LOVE them and provide for them, AND THEY KNOW THEY HAVE BEEN LIED TO!!! Teaching our young to turn on their families and friends and create outcasts as well as teaching our people to turn on their neighbors IS PURE BS!!! Undercover agents " MANY TIMES " find that those they are targeting have more honor and love and respect for family and others THAN THOSE violating the law to take them down! But hey if you DEMONIZE a group of people long enough then any means is justifiable, right? After all they are less than human and are nobodies sons or daughters, mothers or fathers JUST DEMONES, right??? And then we take away their futures, families throw them in prison SOLELY for their choices not their actions, and then we are horrified and bewildered when they come out and survive by any means they can, using the skills they learned in prison??? Why don’t we save our prison and courts for those who let their action cause attention? And treat our sons and daughter who have a problem, with the compassion this nations beliefs were founded upon??? Very truthful response. There is truth in what this Brother is saying, even if he apparently doesn't recognize it. His statement of " DRUG USE IS SO COMMON " is more proof from a supposed drug warriors own words , that the war on drugs IS A FAILURE! If after 80+ years and a " TRILLION " dollars later with all the freedoms lost and families destroyed, people ranches for profit all across our nation. If this war is not a failure, How do you justify this reality of " DRUG USE IS SO COMMON "???

The stash according to you wasn't found in Ann's room. It was in the guest room so the crack addict didn't see the stash.

Seondly, cops buy drugs with Official Advanced Funds that should be serialized before the buy. That means they have the serial numbers of the buy money. If the raid occurred shortly after the buy and there was money in the house my next question is did they compare their serialized money with the money they seized? Did they search the person of Ann and Eddie for the buy money?

If the sntich was in Ann's room, there has to be something unique in that room he saw to make him believeable; a dresser, a picture, the color of the wall, etc.

There are other ways to corroborrate the snitch that skilled drug investigators use but there are also ways unskilled drug investigators know not to use. This stinks at least for now but I'll continue to read it with an open mind.

I just don't buy what this blog is selling when it comes to their conception of police corruption. I know I am just a biased cop but I have never, ever, ever even heard a cop suggest framing a person. Maybe there are RARE individual cops out there who would do this but to suggest that there is a vast conspiracy is ridiculous.

Cops know that if they lie, they will at least lose their job and at worst go to jail. In addition, they would lose all the respect of their peers. Believe me, in a brotherhood like police work, that can be the most important deterrent of all.

As far as the war on drugs being lost, I don't know. It does seem futile sometimes. I ofter wonder at the amount of resources we could throw at other crimes if we stopped going after dopers. My main concern with that is that I have seen how addictive those drugs are and I know that the laws are at least a deterrent to many people.

Now, the majority of users seem to be the poor and desperate with little to lose. You remove the laws and soon more and more of society will give it a whirl. Then what? It makes me think of a wall holding back the tide. Alot of water is coming over the top but if you remove the wall, you get swept away with the rush.

I still believe that MOST of our Brothers and Sisters are trying and fighting to do the right thing! But if an accepted practice or method is later proven to be illegal and no longer acceptable, is anybody at fault??? Those who were wronged by this illegal act, should just accept, OOPS???

You speak of your concerns of addictions and how our laws are a deterrent, I will have to disagree. Those that want to do drugs ARE, and not all drug users are addicts nor abusers. If that is not so, then ever person who drinks is a drunk!

That isn't based on any factual evidence, only fear, what if you peeked over that 80+ year old wall and the threat was only an INCH DEEP??? This year we will kill over 400,000 with tobacco, 112,000 with alcohol, 32,000 with legal pharmaceutical drugs, "" YET "" ALL ILLEGAL DRUGS COMBINED WILL KILL A LITTLE OVER 12,000 people???? Yet you see a flood??? They been keeping records on pot sense 1937, and NO WHERE ON THIS " PLANET " has there " EVER " been a death due to an overdose of pot?????

None of us are for drugs, PERIOD! And the legalizing of drugs " IS NOT " to solve our drug problem. " IT IS " to solve our crime and violence problem! Your statement is so false, it makes me sick! To say that if a police officer lies, that he will be fired. Police officers don't get fired for lying, they get rewarded. Hell even federal agents are allowed to lie, with the blessing of our government.

You seem very passionate about your position and I can respect that. However, I don't agree with many of your views. Maybe you don't know how addictive crack, heroin, and meth are. Comparing them to alcohol is like comparing apples to oranges. I do agree with you on weed though. It seems less harmful than alcohol and probably should be legal. If I ever come upon some weed, I usually just confiscate it with no charges unless it is a large amount.

I hate to break it to you but as long as you hire police from the human race, you are going to have some that do wrong. It will never go away just like there will be priests, doctors, and airline pilots who do the same. All we can do is the best screening process we can find and prosecute misconduct. However, you seem to think that police simply doing their job constitutes misconduct.

Back on Point;

A drug buy used for search warrants is supposed to be a "controlled buy". Meaning the officers have already conducted a detailed interview of the snitch and the interview contains the sntiches version with corroborration that the sellers are who the snitch says they are and the snitch buys it where he/she says they buy it. Those interviews should be detailed with enough facts like phone numbers and the such to bolster the credibility of the snitch later on.
Then you serialize the buy money copying down the serial numbers so when you raid the house you find the money on the person who sold the drugs; or you find it in the stack of money that you plan to seize. Then you assign your personnel and give closing instructions to the snitch. Then you pass out operational plans so everyone has emergency telephone numbers; assignments; and they are clear about what's going on.
Then search the snitch, his/her car if one's involved and then let the snitch make the buy. Listen to the buy; make notes; and after they buy search the sntich good and make sure you listen to tape more than once. Then take a statement because the tape doesn't capture what the snitch sees and the statement should have unique details like pictures on the wall; location of the beds; color of walls, etc to prove the sntich was in there. Then have the snitch swear to the statment making sure your details are dated and timed before you apply for the warrant. With a mountain of corroborration there's not much for the defense to challenge. That Mr. Bean is a controlled buy and if the wire didn't function properly, make sure there's a sworn statement from the snitch that covers all of the details; and a detailed report by the officers who heard it. This isn't rocket science but it takes time, dilligence, and planning.

I was 13 when I watched the biggest man I knew shoot Mexican black tar heroin. His head hit the table and mucus ran out his nose. I thought he was dead! I didn't know if I should run, call for an ambulance OR WHAT! Then I noticed he was still breathing, about 15 minutes later he raised up from the table. His first words were " man that is some good shi*, you got to try this some day "! I looked at him and said ARE YOU STUPID??? You bought this crap and did this to your self??? At 13 I knew hard drugs were crap. I have since buried several on my friends and family over and because of this crap, YEP I KNOW HOW BAD IT IS!!! That still does not justify the harm this policy is doing to our people!

That shows common sense, and many of my Brothers and Sisters still in uniform have told me the same thing! unfortunately last year 775,000 Americans were arrested for simple pot possession? That the same number as the whole population of North Dakota!!! The lies about pot is one of the main reasons this policy is a failure. People know the truth and when they get lied to ALL TRUST IS GONE! Then when they try and tell the truth about REAL DRUGS the kids feel they must be lying about that as well!!! AND THEY RUIN THEIR LIVES OR DIE BECAUSE OF THIS LIE!!! Today our ignorance and fear has pushed our young to harder drugs to avoid being caught with a UA! They know hard drugs will be out of your system in 72 HRS, and pot can be detected up to 90 DAYS! I can not believe those parents would " NOT " rather be disciplining their child for pot use, RATHER THAN VISITING THEIR GRAVE!!!! In the old days most pot users didn't hang with the hard drug users. Now we have forced everybody together in to one world????

Like I said Brother, we don't have all the answers, BUT we are facing the realities and facts we live with! One of the smartest things we could do is legalize pot. This would show all, the truth is being recognized. Our world and it policies WOULD HAVE A BETTER CHANCE OF MAKING IT!!! But as long as we live in a free country and people make choices OTHERS don't agree with and " SOME " manipulate our laws to override individual freedom simply because of their biases and fear of others, NOTHING WILL CHANGE!!!

Do I want bad cops on the streets you ask? No! Should they be arrested? Yes! Do the majority of cops get off easy? That site sure indicates that they do. I wonder why police officers are treated differently, then a regular person when a law is broken?

Doctors and priest don't walk our streets with guns do they? They are not swore to uphold the law or the constitution are they?. They don't have the immunity given to them by government.

If more cops had balls and weren't so afraid to "snitch" on fellow officers when they saw misconduct, then there would be a lot more stories on that site wouldn't you think?

I also noticed you didn't have a "come back" about police officers that lie. You still want to lie to the public about what happens to cops that lie?

Hey Brother, easy does it. Not all my Brothers and Sisters in uniform ARE BAD! Yes each does get any benefit of doubt and their word is taken over every citizens, and today THAT IS WRONG!!! It is one of the hardest jobs in the world, TO DO RIGHT , AND THE MAJORITY ARE TRYING! Many have put their lives on the line for me, and I for them. But EVERY GOOD ONE suffers the lack of trust and disrespect caused by the bad ones! And now due to this failed policy called the war on drugs, the attitude of us against them and ANY MEANS is justified, has cause more harm ON BOTH SIDES OF THE FENCE " AS WELL AS " each side justifying their actions!!! AND FOR WHAT??? Every time a warrant is served, and the person is knocked down and abused and his family to, the anger grows. Every time a warrant is served and IT IS THE WRONG HOUSE, and people are STILL ABUSED AND EVEN KILLED, and nobody is held accountable, THE DISTRUST, HATE , AND ANGER GROWS! Every time we watch on TV after a chase and the person has ALREADY GIVEN UP and spread eagled themselves on the ground " BEFORE " the cops can get them. And we see 5 or 6 jump on them and abuse them ON CAMERA, THE ANGER GROWS! That’s why I am for legalizing drugs, to take the excuse AWAY FROM BOTH SIDES! Part of the problem is seen BY ALL! We have Americans and their families being terrorized and even killed, some even innocent!!! Simply because of the manipulated fears and biases and agendas OF THOSE WHO CAN NOT RESPECT THE RIGHT TO INDIVIDUAL FREEDOMS!!! These Americans and their families are not being abused and killed, BECAUSE of their actions, but rather their choices!!! Yet on the other side of the fence we have those who have manipulated their fears and biases into laws for THEIR PERSONAL AGENDAS! And we have those with authority violating Americans WITH THEIR ACTION AND NOBODY IS BEING HELD ACCOUNTABLE??? GO FIGURE!!!

There was a time in this country MINDING ONES OWN BUSINESS WAS THE NORM, " NOT " THE EXCEPTION! A time when it was morally unacceptable to spy on you family and your neighbors! A time when people rights to individual freedoms WERE NOT overruled by self righteous bigots with biases and personal agendas! A time when religion was kept in your heart, not on your sleeve to be used to justify attacking others. Brother so you will know how bad it is going, please go to this site drcnet@drcnet.org look on the left hand side and you will see WEEKLY COP CORRUPTION. Every week this comes out. It also has some really good information and links.

We are in agreement as to the majority are trying to do the job right. " BUT " when our own refuse to stand against wrongful abuse of powers, they become the " KINGS MEN " NOT THE PROTECTORS OF OUR PEOPLE!And each time this happens the "" US AGAINST THEM "" mentality grows stronger "" ON BOTH SIDES ""!!! I want to bring back the days of looking in your rearview mirror and seeing a cop behind you, and you wave and invite them to coffee. TODAY the first thing every American does is go through a mental check list. Is my registration current, is my safety sticker current, is my insurance up to date, how much is this going to cost, are they going to tow my car, ARE MY PAPERS IN ORDER!!! Does that sound like America or Russia???

As a family member of one of the victims in the Davis/Colomb case, I watched and witnessed the heartache & tears of this family. I always had faith in our law enforcement and government system. I also watched it fail us miserably. I watched innocent people have their life taken away and put in jail cells for something they didn't do for 3 1/2 months. They were bound by hands and ankles like murderers, and there crime was "nothing". It was all about another notch being put on the prosecutor's belt. I watched these families struggle fianancially to make ends meet because their spouses were locked away. There are "corrupt" cops and political officals, I only thank God above, that Judge Melancon , God bless him, saw the truth and reached the decision he did. Justice was served!

Your tragedy is becoming a COMMON PRACTICE in our country. Welcome to the NEW AMERICA, you can have as much freedom and rights AS YOU CAN AFFORD! How many of those who violated your family, HAVE BEEN HELD ACCOUNTABLE???? At least your not one of those WHO'S FAMILY MEMBER WAS WRONGFULLY KILLED with no accountability!!!

They system we have ""WAS ONCE"" the best in the world. Today those with biases and personal agendas have hijacked it! The political arena in this country is geared for those of wealth and dynasties. A common American CAN NOT even get in to the game, UNLESS supported by one of the two major parties. Therefore if we can't even get in the game, THE GAME " DOES NOT " REPRESENT THE COMMON AMERICANS!! It is time to take back this country! There should not be another law AT ANY LEVEL that is not put to a vote BY US, with a 2/3 majority to pass! Our laws CAN NO LONGER be left in the hands of a bunch of self serving politicians. If we fail to stand NOW, MANY TODAY and those coming behind us DON'T HAVE A PRAYER!!! IMPO!!!

Thanks for the support and your honesty, OUR COUTRY NEEDS MORE OF IT!!!! We still have a chance to turn this country around, and the more people that will stand up THE BETTER!!! These self serving parasites that put their biases and personal agendas above EVERYBODIES freedoms and right to Individual freedoms, CAN ONLY GET AWAY WITH WHAT WE LET THEM!!! To think ANY POLITICIAN at any level will enact term limits, is BS. But WE CAN, and when you pull that curtain to VOTE, vote for ANYBODY that has not been there more than 2 terms! If they are to afraid OR TO SELFISH to do the right thing, THEN LET'S DO IT FOR THEM!!! IMPO.

Thanks for the info! I don't see myself as anything special. Just a American refusing to live under others biases and manipulated fear nor willing to accept this smoke and mirror BS any more! I actually thought about taking the two young granddaughters my lady and I have been taking care of since they were infants,( they are now 9&11 ) and moving to another country. The more I though about it, THE MORE SHAME I FELT AND THE MADDER I GOT! My ancestors gave their lives and their blood to give me these FREEDOMS AND RIGHTS and this COUNTRY, AND I'LL BE DAM*ED if I let a bunch of self proclaimed, self serving bigots nor self righteous religious zealots run me out or turn my kids in to slaves!! AIN'T HAPPENING! For the first time we now see many of the churches and their flocks waking up and seeing how they have been manipulated. Those who have used their FALSE faith as weapons and tools against their neighbors and for worldly gain, or to claim special status, do so against and at the cost of the very faith they claim to have! IMPO.

STAND UP AMERICA!!!
