Kimbrough's privacy concerns awfully convenient

Texas Youth Commisison conservator Jay Kimbrough has finally figured out a sure-fire way to keep anything like the Pyote sex scandal from happening again - just don't let reporters or the public have any information about complaints by youth against TYC staff! That's the upshot of a report today by R.G. Ratcliffe in the Houston Chronicle ("TYC bars access to details of most abuse allegations," May 3), who writes:
TYC officials said Wednesday they recently changed the policy based on a new interpretation of the Texas Family Code that mandates privacy for youths. Previously, the agency released summaries of inmate mistreatment cases with only the youths' names redacted by black ink. ...

But several lawmakers said the troubled agency cannot look like it has something to hide.

"To me, this is moving in the wrong direction," said Sen. Juan Hinojosa, D-McAllen, one of the legislators pushing for TYC reform. "I don't want any reports sanitized except to remove the juvenile's names."
The change in policy was discovered when the Chronicle sought information on the announced firings of 66 TYC staff with felony convictions. Wrote Ratcliffe:
The change in records policy became evident this week when the TYC responded to a public information request from the Houston Chronicle.

The newspaper had sought the names of 66 TYC staff members who are scheduled to be fired because they had felony arrests in their pasts as well as allegations of misconduct while working at TYC.

TYC responded by giving the Chronicle the names of the individuals as well as statistics on mistreatment of youth allegations against them. But detailed summary reports were released only in cases in which the youths were age 18 or older.

Of the 66 TYC staff who had felony arrests, 31 had allegations of youth mistreatment made against them. There were 80 total complaints, though six of the staff members had five or more complaints lodged against each of them. But because of the change in policy, the Chronicle was provided with the detailed summaries of just eight of the 80 allegations.
Regular readers know I think open records are absolutely critical to ensuring accountability at not just prisons and law enforcement but all government agencies.

These records have always been public in the past, but I think there's a secret motive behind Kimbrough's claim they now should be private: By forwarding them to the Attorney General, Kimbrough puts off this information becoming public for up to 45 business days while the AG makes a determination.

By then, of course, the Legislature will no longer be in town. Convenient, huh?

The comment that the Freeman supporter made about ""I hope that someone runs a check on your credentials and see where life has taken you...I'll bet they'll find complaints, personnel actions, and maybe demotions and firings...hmm...It seems to be your life" that sounds a little like a threat of retaliation, huh. I think that Crockett has had enough of that already, thank you very much. The supporter might be MVS or JH. I know that it is not Gwen because she cannot string together a coherent sentence. That was mean I know, but true.

If you haven't noticed yet- Grits added a payment option on the front page. He's going broke trying to help us. I don't know about you all, but it's the least I can do by putting some money towards the one person who has made it possible to keep us all informed when others have done their best to keep us in the dark. Grits works hard for us. It would be nice of us to show him some appreciation and help him out when he's helped us.

If Freeman has done such a great job, then why has he been suspended twice and why are there so many people who despise him so much? Show me another TYC campus that has that many problems and has so many TYC employees and TYC parents in an uproar. I don't see it at Al Price, Corsicana, Mart, etc. Their supts may not be perfect but they are 100 times better than Freeman.

That sounded like a threat? My gosh, why? He's not attacking any of them! He's talking about Freeman, not them. I'm sure there are some nice people there but it's hard tell with how some of these Crockett people are responding so rudely. Why don't you attack his points rather than him personally? Did Freeman teach you that?

I work at Crockett and there are only a few options for supporters. The regulars, Gwen (can't spell and wouldn't know how to find this site), Judy, Melissa......but there is one new important one to mention. Anyone who works at Crockett has noticed the new person in charge. The new HRA whose husband is some big wig at TDCJ, was calling the shots before Freeman got his walking papers and still appears to be. She was evidently given full authority. She tells the supervisors who will be fired and she decides who gets hired. SHe's been kissing Freeman's ass since she arrived adn vice versa.

Let me make this very clear (I am 12:27), I know there are good people at Crockett. I know there are some good things happening at Crockett. I know the students make great crafts and projects. The campus itself is very nice looking. I am NOT against the campus or most of the employees. My issue is with Freeman. I have solid reasons for my opinions. I don't base any on rumor. None of your attacks or side tracking are going to change that.

I wonder how many of us work together everday, but can't really talk because 1. it would be unprofessional and 2. no one really trusts each other on campus. I truly like a lot of my co-workers and hope and pray that when the dust settles and some changes are made, we can trust each other and feel safe enough to really talk and get to know each other instead of spending our time avoiding the daggers coming into our backs. well, to answer that, let's start with Evins... under a federal lawsuit, investigated by the DOJ. Mart... two lawsuits have been filed, with the superintendent being named as a respondent (but that's chicken shit because he is a good guy), West Texas (I don't even think I need to go there and explin that one, nor should I have to explain Ron Jackson and the recent inditments of that perverted JCO), Al Price... uh, they got a fresh start after the hurricane wiped out their population, but the jury is still out on that superintendent... you guys at Crocket don't know how well you have it and it seems you don't apprecaite it, so if that's the case, move on. Freeman hasn't been named as a defendent in ANY lawsuits. Believe me, those of us who have moved around stay in touch with each other, and we constantly compare our campuses. Crockett, under Freeman, has been stable for sometime. And believe it or not, I used to work for Freeman a long time ago, and the only people who had problems with him were the turn-on-you-head idiots who constantly abused sick leave, were insubordinate, or otherwise had mental health issues of their own and should have never been there to begin with. The ones who came to work and did their job were the ones who never had a problem with him. So – ES folks… he’s one of the better ones.

--Which I'm 100% agreeing with this post. Freeman has held employees accountable for their actions and actually made them do thier job, which seems to really upset some people. Is that such a bad thing? NO.... Just do your job and quit b&%$#ing.

8:54pm There are 3 or 4 or 5 sides to every story. As far as a stable campus....yes, Crockett has been stable for some time, but can you really only attribute that to Freeman. I don't think so! We all play a role (those of us that actually come to work). But there has to be some middle ground. The core group of staff who do our job (because we have ethics and need to keep our jobs) should be able to do that job without all the extra crap that comes along with the current leader. So, don't be so idealistic.
By the way, I've had a few run-ins or disagreements with Freeman but have maintained respect for his position. And I do not abuse sick leave, have not been insubordinate and do not have mental health issues (other than the runof the mill issues that come along with sticking with TYC for so long - hahaha).

I agree with you 9:32, there are a number of excellent employees both in supervisory roles and non-supervisory roles that make Crockett run so well. Freeman gets a lot of the credit for a well operating Campus, but rarely gives credit to those below him that work hard to keep it going. Maybe if he comes back, he will appreciate the honest hard working employees instead of the ones that kiss his a**!!!!

I think Judy started that and it just snowballed from year to year. She always sends out the emails telling us what our choices are. You wouldn't believe some of the stuff she comes up with. If you don't chip into the Freeman pot then you get nasty email reminders and she snubs her nose at you. I really can't afford to give the money, but if you don't she makes you feel worthless.

If he doesn't come back, no only will it be ashame, but I bet other Superintendents will be beating down the gate to come to Crockett and take over the best program in TYC. It is a shame that a handful of former employees and one ignorant Mom of an ex-TYC youth can bring down all this garbage on the facility and get Freeman suspended over rumors and lies. If anyone out there on this blog has any facts to the contrary, post em or shut up.

10:39- What I reported on Freeman wasn't a rumor or lie. It is very real. If the new administration really is interested in cleaning up TYC, Freeman won't be back. He did some pretty bad things. Just because you don't know all the details doesn't mean it didn't happen.

Facts - Freeman has the morals of an alley cat. Who lives away from his wife for years and years and years? Who has long term affairs with many crazy women apparently attracted to aging, balding men? Who enjoys the reputation of a womanizer? Who admits in open meetings to be a self-proclaimed smart, pool of knowledge? Freeman rules by fear and intimidation if you don't tell him what he wants to hear. He gossips about everyone. I have heard him say degrading things about everyone that walks past him on campus with the exception of Gwen. hmmmmmmmmm wonder why that is. I know it breaks your heart, but yes, even you, JH. And speaking of gifts, not just from employees but from parents of youth. And if that isn't a conflict of interest, I'm not sure what is. He has stood in public meetings and referred to Houston County residents as watermelon pickers and country folks. He has referred to people's personal problems in open meetings. He has confronted people in open meetings on things that have no factual basis, simply rumors that he probably started in the first place. He makes extravagent purchases like digital cameras, flat screen TVs, and videl equipment in the name of "State" business. What competent supervisor tells his "people" as he refers to us, "Tell me what you think. I want your input, even though I'm going to do it my way anyway". Wow, those are the words of a really great leader, right?
Should I go on......? I know it's Crockett, but I do actually have a life and don't have enough time to type it all in.
By the way, I do agree that Crockett is a great program. I'll give him some credit but the program will continue to be great without him. So, not much credit going his way. The past few weeks feels like breaking free from some communism regime? The campus is much more relaxed and still in control with very few problems. Sorry to burst your bubble, psycho.

The most expensive thing....I'm not sure because I have never contributed. I must admit I do go and smile when they have those stupid things. I know there was a huge gift card to Bass Pro Shop but I don't know the exact amount. I remember thinking when I heard how much it was, "that's like a freaking car payment". Then, one of his CW followers who is no longer there bought him a piece of art work that still hangs in his office. But again, I don't know the amount. Jusy doesn't make us just celebrate his anniversary at Crockett, but we also have to celebrate his birthday every year. It's ridiculous.

Whoever is typing for Gwen has been tripping tonight. Yeah, I noticed that comment that they made about the BEST SUPERINTENDENT IN TYC, man, what have they been smoking for the past 6 years? But you know, if he protected me and gave me promotions and raises that I didn't deserve, I guess I would love Freeman too.

And the comments about the TYC mom, that is just crazy. Genger Galloway is just standing up for her child, regardless of what crime he committed. A good parent loves their child no matter what. She has helped to put a lot of heat on TYC and Crockett State School, and it was about time that the Gov and the Lege be made aware of the problems within the agency.

I agree, somewhat, that parents must stick up for their kids. But I do NOT believe that putting her other children (the victims) in the spotlight was the best decision. Anyone who did not know (including all of their peers) what was done to those younger kids, definately know now because of the media spotlight their mother created. Any by the way, I have heard that some of the allegations brought out by mother and son were proven to be lies. Nevertheless, if I believed one of my kids was being mistreated, I would stop at nothing to save him, so I can't judge her. I do hope the intentions don't prove to be monetary.

Do you know how many times Crockett has had to send staff out to help other schools? Do you know how many times they've come back thankful that they don't work at another facility? People are still posting about Mr. Freeman because there's no word of what his official status is. It's called nervous anticipation. People are putting their frustration to the blog. When Freeman either is fired, retires (and we will know why he did) or comes back, there will be another huge round of postings and then it will stop. Until then, it won't. If you don't like that, you're the one that controls your fingers and computer mouse- don't come to this string. People are going to say what they feel whether you like it or not. You can't control that, which sounds like the issue you are struggling with being one of Mr. Freeman's supporters. You can't control whether others like him or not. They have their reasons, you have yours. I agree with 10:50, when you fell back on making fun of the woman's facial hair and then calling the people here "meth heads" because they don't agree with you is a poor example of what is the correct way to post here. Especially when you just complained about it. You're trying to correct others in what they say but you resort to that? Not only that, but you made this comment:

It sounds very much like a threat to fire people because they don't like Mr. Freeman. Last I checked, there is no place to sign anywhere on any job hiring packet that states, "You must like your supervisor and the people around you". It's not there because it's not possible. You're not going to like everyone. Everyone would be fired. These people are still working because they are able to compartmentalize their dislike of Mr. Freeman from the process of doing their jobs. Some may truly despise the man yet do their jobs at a level in the top of their field. Disliking Mr. Freeman does not disqualify them from being a good employee. However, from what you posted, those two issues are not allowed to be separate. You MUST like Mr. Freeman or you have to go. No Sir, you don't. If that is how Mr. Freeman and those close to him run the Crockett campus, he needs to go. If these are the types of management skills and tactics you are referring to that are the best way to run the Crockett campus, then I surly do hope the legislature and TYC administrators read this post. If their eyebrows don't rise at that belittling and intimidation style of management, and find it unprofessional and unnecessary, it would surprise me.

2:43- Here are my thoughts on this for what it might be worth.

Everyone has either seen on TV or heard of monkeys throwing their feces on others when they are angry or upset. Humans share 99.9% of primate genetics. In my opinion, other than physical appearance, one of the few things that separates us from the feces throwing monkeys is that after we do it (and there's a lot of it going on here), we almost always have the thought to grab a mop or broom and dust pan and clean it up. If we don't, we know it will create an unclean environment and a lingering smell no one will want to be in. I've never seen or heard of a monkey cleaning up after them self. At some point, after everyone is finished throwing, can we prove we're really not at the same level of primates? There's no doubt people will continue to get mad and throw. Just be as willing to clean it up after you see the mess it makes as you are to fling.

Hey guys, I'm going to briefly disrupt this Freeman chain. You guys need to pony up something for Grits. I just found out that Grits' former employer, the ALCUTX, offered him a contract and then backed out of it.

We've all be burned with something like this before, and know how that sort of thing feels.

Guys I hate to break this to you, but I think - and I want to emphasize think because I don't have the facts - but our boy Grits used to employed with the ACLUTX which was headed by our soon-to-be Ombudsman in TYC.

I'd hate to think "Will" had a hand in that post or that contact, but all of you know, that kind of shit IS NOT what we need in TYC.

If he didn't have a hand in it, OK. But Grits is a stand up kinda guy and won't disclose it if it was Will.

If in fact this Will guy did this to our boy Grits, that's a new kind of burn we can expect. But let's hope that's not the case.... where have you been pinpoint? lol....

I really appreciate the support. Just to have said it, I don't want y'all to hold a grudge against Will on my account. I try not to trash talk ACLU on the blog, though when Will was hired as ombudsman I gave what I think is an accurate description of his strengths and shortcomings. But my history with those folks should not color other people's interactions with Will or others at ACLU - there are some wonderful, committed people there who I'd trust in any circumstance, and a couple who shall remain nameless who I wouldn't trust any further than I could pick them up and throw them. (In regards to the reneged research project, one of those nameless figures bears greater responsibility than Will.)

Will and I have had many differences and IMO he is one of those figures in life whose greatest strengths are also his greatest weaknesses. His biggest problem will be learning to work in a state agency environment - ACLUTX is REALLY loosey goosey by comparison to how decisions are made in a bureaucracy. If he can get past that learning curve, and it would help if he surrounds himself with experienced staff, he may do well at the ombudsman gig. It's worth giving him a shot, in any event, because it's who you've got and for what it's worth I can tell you he doesn't have bad intentions - he'll try to do a good job. Suerte amigos!

8:03, I have a differing opinion of Blu, but everyone is entitled of their own opinion. I too have been written up by Blu and his henchmen, but they weren't always things that were my doing. I don't mind owning up to my own mistakes, but don't go looking for shit and making up stuff to write me up on. That is the kind of dirty stuff that Freeman and Blu are despised for. I am also referring to preferential treatment, such as writing up one person for something, but overlooking someone else for doing the same thing. Everybody makes a mistake every now and then, but when they try to get you for every little mistake, that is ridiculous. But if I had been part of the "Wolf Pack" then those mistakes would have been overlooked. You get the idea?

I just found out about this site today, and I've been reading all the interesting comments that have been made about TYC, Freeman, Nicholson, and others. In reading all the comments, there was one that just stuck out among the rest. I'm figuring the person who made this comment is a supporter of Freeman and Nicholson. It said:

"If you have been fired, that's probably a good thing. You really sound hateful. One person, or two or three, shouldn't be able to
throw you off balance like this, please get help."

I'm not sure if this comment was posted because the person actually believes it, or it was just to get a reaction from someone, or both. If it is a reaction you want, then I'll give in.

I was fired from Crockett for a very, very minor infraction compared to the allegations from West Texas. Of course, the infraction was used to cover up the real reason for my termination, which was retaliation. What do you do when you have busted your butt getting an education and good credentials to your name, and then someone from administration asks you to do something that you know if you are caught and/or hung out to dry, will just throw all that work in the trash? Do you report them? To who? The people you are about to report them to are the same ones saving their butts. Do you quit? You can't, even though that is what they want you to do. You have a family to feed, bills to pay, and there is no other job that pays as well in Crockett. I knew I was doing my job to the best of my ability, like everyone else was. Even if I could run away, I wasn't going to do it because I believed that what I was doing was right, and if I got fired, I would have a chance to tell my side during a hearing. I was not going to sacrifice my credentials just to be "accepted" by the powers that be. My credentials give me a higher degree of obligation to report anyone who is mistreating someone, especially the youth. And I was going to follow my code of ethics, even if I had to go over a few heads and refuse to follow directions to do otherwise.

Now, the comment was made that one, two, or three people should not throw someone off so much. When you are doing your job just as well as everyone else, but no matter what, you get put on the fast track for minor things all because you are not part of the "team", it can leave you a little disgruntled. And what makes you more disgruntled is when you get fired for something so small, there's no one to talk to about the injustice you know just happened, and you wonder now how in the heck you are going to pay the bills for the next month. Snd all of this was happening because someone didn't like you? I agree, don't let a group of people who have betrayed you influence how you perform on other jobs or live your life, but try to understand why so many people are holding grudges against the administration at Crockett. Maybe this situation has not happened to you. I really hope it doesn't.

Even though my family and I experienced hard times following my termination, the end result was in my favor.

And I have to say, I'm not sure why some people are saying Nicholson has found religion. He's still trying to cover up stuff. I found out that he had been telling people that he didn't want me fired, but it was "out of his control". Thank God for the Open Records Act. I'm not sure about now, but that Act applied to emails, too:)

but WHO do YOU think you are to judge Mr. Nicholson's religion?? Stick with the FACTS. I think that's all people really care about anymore.

Well, I don't really care who did what 1 year ago. Things have to change, like NOW.

No one feels secure in their jobs right now. Everyone is in fear of back stabbing.Zero trust level and There is an atmosphere of chaos around here. It has to stop!

We need Blu back and we need to get over all of our "feelings". We have youth to take care of here. We can't do that with all of this going on!

It is very sad to me that so many people are being suspended. I am not saying that you should get to stay if you have done wrong. But the "jury" is still out. I feel like all of the lies will be brought to the light.

I appreciate all of the hard work that so many have put into CSS! It can't be easy working in the current environment.

The following paragraph goes along with my complaints about Freeman and Blu, that they were not treating their employees fairly. They disciplined certain people too harshly, and didn't discipline others harshly enough.....

"Blu Nicholson, named acting superintendent of the Crockett State School a week ago to replace Don Freeman, who was terminated after being accused of not following policy in disciplining an employee. Hurley said Nicholson was suspended "pending investigation of prior allegations of mistreatment of youth." Other officials said the allegations involve inadequate discipline he ordered for an employee who slapped a youth."

Now, Freeman and Blu supporters, go ahead and spin that story. If they had been fair in their management and discipline practices, then they would not be on the hotseat right now. This investigation has vindicated the employees that were wrongly terminated and/or forced out, and also gives the former employees ammunition for their pending lawsuits.

Hello, don't you get it. This is a political issue. FIRE EVERYONE, then get the hell outta there and let the new "central office" rehire everyone and deal with all of the law suits.
