Kimbrough's privacy concerns awfully convenient

Texas Youth Commisison conservator Jay Kimbrough has finally figured out a sure-fire way to keep anything like the Pyote sex scandal from happening again - just don't let reporters or the public have any information about complaints by youth against TYC staff! That's the upshot of a report today by R.G. Ratcliffe in the Houston Chronicle ("TYC bars access to details of most abuse allegations," May 3), who writes:
TYC officials said Wednesday they recently changed the policy based on a new interpretation of the Texas Family Code that mandates privacy for youths. Previously, the agency released summaries of inmate mistreatment cases with only the youths' names redacted by black ink. ...

But several lawmakers said the troubled agency cannot look like it has something to hide.

"To me, this is moving in the wrong direction," said Sen. Juan Hinojosa, D-McAllen, one of the legislators pushing for TYC reform. "I don't want any reports sanitized except to remove the juvenile's names."
The change in policy was discovered when the Chronicle sought information on the announced firings of 66 TYC staff with felony convictions. Wrote Ratcliffe:
The change in records policy became evident this week when the TYC responded to a public information request from the Houston Chronicle.

The newspaper had sought the names of 66 TYC staff members who are scheduled to be fired because they had felony arrests in their pasts as well as allegations of misconduct while working at TYC.

TYC responded by giving the Chronicle the names of the individuals as well as statistics on mistreatment of youth allegations against them. But detailed summary reports were released only in cases in which the youths were age 18 or older.

Of the 66 TYC staff who had felony arrests, 31 had allegations of youth mistreatment made against them. There were 80 total complaints, though six of the staff members had five or more complaints lodged against each of them. But because of the change in policy, the Chronicle was provided with the detailed summaries of just eight of the 80 allegations.
Regular readers know I think open records are absolutely critical to ensuring accountability at not just prisons and law enforcement but all government agencies.

These records have always been public in the past, but I think there's a secret motive behind Kimbrough's claim they now should be private: By forwarding them to the Attorney General, Kimbrough puts off this information becoming public for up to 45 business days while the AG makes a determination.

By then, of course, the Legislature will no longer be in town. Convenient, huh?

How is it political? These are facts and have been facts way before Kimbrough and Owens came around. They are the only ones will balls enough to clean up the mess within TYC, Lord know that the Board and Central Office didn't have any cajones. They let the local administrators run loose and do anything that they wanted. I may not agree with everything that Ed and Jay have done, such as firing all felons, but getting rid of the BAD administrators is crucial to fixing TYC.

I have blogged on here for several weeks and it has been great to know that there are others who share my point of view about what has been going on at Crockett since 2001. I was there before Freeman was there, so I am able to compare what the place was like before and after. With Rey Gomez as Superintendent, the campus was a nice place to work and people were allowed to do their jobs and not fear harassment from supervisors. After Freeman took over, there was a dark cloud over the place. People were running around “inside the fence”, and I am talking about staff not students. He and Blu demoted several experienced PA’s and put some of their hand-picked flunkies in their place, namely Terri, Pam, Gwen, and Traci. Numerous hardworking JCO’s, caseworkers, and others were abused, mistreated, rail-roaded, and terminated over the past 6 years, all in the name of the “One Team” approach. Students were mistreated and abused by certain staff members, and this was allowed to occur and the staff did not lose their jobs. In the meantime, other people who had never abused students and were doing their jobs were written up, harassed, terminated, or forced to resign. People had no one to complain to because their grievances were being dealt with by Freeman and Blu. Central Office did not “have our backs”. This happened to not only me, but to many other people as well and they are finally able to speak up. For those who still work at TYC maybe you have a chance to see things improve and can continue your career there. At least for me, the best thing that I ever did was leave TYC, and I would never go back regardless of how much they paid me. I am just glad to see that Freeman was terminated and Blu will be terminated also. That you can count on because he was involved in too many dirty deeds in the past. They say that he has found religion and that is good for him. He needs to realize his mistakes and move on with his life, and never repeat the awful things that he has done to others in the past. I know that I forgive him and Freeman for what they did to me, so now I am able to move on. Signing off...

I know who you are 12:13am and you need to state the facts. Don't you think that Open Record applies to disciplinary actions too? Nothing in there about making a report or someone not "liking you" (grow up). What about the people who constantly had to do your job because you were ALWAYS out sick? What about the ones who had to do your paperwork because you did NOTHING? What about the time your supervisor moved you to a dorm of younger kids with good CWs to support you because you were scared of the older boys while those of us who did our job got no such change? You must have forgotten about that part of the situation. You have the right to your feelings and opinions, but I agree with the others. Let's stick to the facts - we're way past the opinions and playing the victim.

Guys, I know that we have really gotten off on blaming Freeman and Blu and the issues at Crockett, but really, from the sound of it all the Legislation, Kimbrough, and Ed want to do is turn us into a TDCJ Jr. That's not what TYC is about. What happened to advocating for our jobs and for resocializing the youth? You know, good or bad, I know that Freeman has given his life to this agency and he's been cast out with the trash. I have known Blu for almost 15 yrs now, well before TYC, and all he's ever wanted it to help delinquent youth become successful citizens. Whether you agree or not, the fact is that this is not what Kimbrough wants...He wants HEADS ON A PLATTER. Ed wants a MINI TDCJ. Guys I've worked in a lot of places, including public schools and we need TYC. We need resocialization. We need people that care to work with these youth.

I agree with 1:45p. I just came to this post to be nosy, but as a TDCJ employee. I certainly don't want to work with kids in this environment. As "smart" as my own kids can we, I certainly don't want to raise someonelses. Now's the time to put personal issues aside and fight to keep your jobs and your program. Individual employees are not the victims, but TYC as a whole is. Stand Together!!

I don't know how many know this, but the talk is closing facilities and making new ones in metro areas. If this much conflict is going on at CSS (and has well before Nicholson and Freeman, I know I was here) what better reason to close it. We're giving them what they want. What are we going to do for jobs then. TYC is the only life and as already pointed out some of the best pay in this area. I can't afford to live in Dallas on my salary. Can you?

Give me a freakin' break! It's been said before and it's worth repeating, Freeman didn't know half of the crap Nicholson was putting together. All he cared about is if it would come back on him. And if Wagner or Nicholson wanted someone gone they knew how to set up the paperwork and manipulate Freeman into believing it was for cause. Remember, one of those two people was a psychologist at one time and knows how to manipulate people. The other just plain knew how to manipulate the system.

If Nicholson is being fired for not firing someone who slapped/choked a youth in the cafeteria, then that person better get ready because they're next. That person will have to move a long ways away to escape what everyone here knows about them.

If you're talking about that caseworker from Freedom last year you need to keep one thing in mind about what you think you know (and the person probably telling it to you). She won her job back without even having a lawyer. How airtight do you think Freemans/Nicholsons/Wagners case was against her? They built up a case against her using the tried and true "reasonable request of a supervisor". From what I hear it wasn't too hard for her to prove that changing the rules to get rid of one person was as transparent as your office window.

Freeman may be the one to hire and fire but he does so based on the recommendation of the assistant superintendent (Nicholson) and the PA's (Wagner, Toliver, etc). Freeman had no clue what the caseworkers and JCO's were doing day to day. He left that job to Nicholson, which he micro-managed very well. And he doesn't really hire or fire anyone, he just signs off on it. No one sends their job application to Freeman. They send it to HR. If a PA had a problem with a caseworker they'd bring it to Blu and then determine if they should write them up or not and what policy to use. Freeman doesn't get involved until the person is appealing their termination. I know he never showed me around on my first day of work and introduced me to my co-workers. So, No. He doesn't (or now I guess didn't) hire or fire. just signs off on it. The legwork was all done for him and paperwork presented like a christmas gift with ribbons and bows on it.

I heard about the Freedom caseworker situation, and I think she was one of the people that talked to the Dallas News about it. She was done the same way that a lot of other people were done, singled-out and pursued until they had enough dirt for termination. I am not against firing someone for a good reason, but damn don't go making shit up and digging for it!!
Someone mentioned earlier that I had "messed up" my own life and I am whining about it. I guess crossing Freeman and Blu was where I messed up, maybe I should have been a better suck-up. Looks like Freeman and Blu messed up their lives too, huh.

Things were soooooooooooooo much better last week when Don Freeman was gone. People started walking around with confidence with Blu being in charge. The atmosphere was lighter. Unity again.

We had a good thing with Blu. He would get out there and interact with both the youth and the staff. You can count on him when you need him to be there, and he's been in the agency long enough to know staff can be just as (in this case even more so) criminal minded as the youth.

I agree with part of your comment. Freeman and Blu are small potatoes compared to the other issues in TYC. Shouldn't we be focusing more on the systematic dismantling of an agency by Kimbrough or the takeover by Ed "I wanna run a mini-TDCJ" Owens? How about the West Texas scandal, anyone looking at how to prevent that in the future? How about the continually rising turnover rate that has not improved since the so call "Rehabilitation Plan" was published? Hey Lege, show us the money? What about the "dream reform", is it just a dream? Should we not be focusing on these issues?

If Freeman and Blu are as stuck on themselves as everyone says they are, I would bet that they can't stop laughing if they are reading all the attention they are getting on this site. I say we change the subject.

I've seen a lot in my time with TYC and I too can say that I could stand Blu in the beginning due to the "guilty by association" thing, but after seeing him in action and hearing his ideas and views, it would be a loss to CSS and TYC to lose him. I hate to think that Kimbrough is going to take a good man and ruin him, just because he needs to make a name for himself.

For once Kimbrough use you head and not your SUPER ego! He's already proven himself through the lie detector, what else do you want? At this point, you're not doing anything, but counting heads anyway.

Freeman knew what CW's were supposed to do but he did not give them the time and resources to do their job. He had them doing JCO duties most of the time instead of doing actual casemanagement duties, ie security work, cafeteria duty, etc. That is what JCO's are supposed to do, not CW's.

Back to what I was saying, all of you need to be out on Campus making sure everything is okay, don't so much as look at the kids, we need to make sure they feel safe. If they tear up the Campus, we can fix it, we are getting plenty of money this year. When I am Superintendent, we will have anything we need. Reading about D.F. and I do not want to call his name. Years of bad feelings, anger, resentment ,and fear are overwelhming. I have not heard anything I did not already know. There is some relief, to know so many others could see what I saw.
Of all the the bad things he has done, this just may be the topper.
Did he do it? I knew a good man in his upper 30s, who wanted so bad to be a supervisor. He is some ways looked up to DF and DF knew this. He made him a supervisor. This man became a yes man. Yes sir, I'll do it sir, right away sir. He had a family and kids. Well, the pressure of his job became tough. DF had him so scared that he was going to fire him if he did not do better. The man was shaking & trembling, he was so upset. I said it isn't worth it, just chill and do your best. In a few months he died of a heart attack. Did DF do it, I believe he did, can I prove it....no.

Please look at the way they treat the staff. It's being turned into slavery. You work long hours, not get paid for it and when you speak up, you get written up or fired. It's not fair. No one has actually spoken with the line staff or the supervisors at the facilities. Kimbrough will come and speak with a youth that has committed an offense, but will not speak with a man/woman that does not have a criminal background. What is the world coming to? You can rob or kill a person and live a life of luxury - (free education, room and board). But the people who finished high school, obtained a college degree are treated like slaves. Can some one please explain this to me?????

7:37 - did you see the date of that quote? That was on May 11th. Plus, it was in the HCC- a paper that only prints bi-weekly.

Blu Nicholson, named acting superintendent of the Crockett State School a week ago to replace Don Freeman, who was TERMINATED after being accused of not following policy in disciplining an employee. Hurley said Nicholson was suspended "pending investigation of prior allegations of mistreatment of youth." Other officials said the allegations involve inadequate discipline he ordered for an employee who slapped a youth. Until the investigation is complete, Hurley said, Jerome Williams, a juvenile corrections official at the agency's Austin headquarters, will serve as acting superintendent.

I saw that the local Crockett paper talked to Jim Hurley on Tuesday, May 15th, and said that Freeman was suspended and not fired. The story in the Dallas News was from Monday and said that Freeman was terminated, but they must have had the wrong information. So I guess that he is still on suspension. Justice will not be served until he and Blu are out of Crockett for good. Even if they both get their jobs back, they need to be assigned to other campuses because Crockett needs a change of administration.

What exactly was Blu behind? I have not seen anything at all stating what Blu has done? We know about Freeman's dirty deeds (i.e. accepting gifts, sexual harassment, ruling by fear and intimidation), so what has Blu done? Freeman called every move on the Campus, and Blu was the only one that had the balls to stand up to him. Even when Blu's job was threatened by Freeman, Blu still stood strong with his integrity. I maybe able to TRUST you, if you can write the truth.

Well you must not know him very well, or maybe he has you fooled. I saw many times where he personally ordered people to do unscrupulous things that were against policy. Such as do illegal restraints, falsify documents, and rig Level hearings. The investigators have statements about all of this. I worked with the man for many years and saw it firsthand, and these orders came from him and not Freeman. He knew that Freeman would "sign off" on his decisions. Blu basically ran the campus while Freeman was busy pimpin' the ho's. You need to wake up to reality. Blu has done plenty of bad things to deserve to be canned, and he is not an innocent victim. He may be a "good Christian" now, but that does not erase every bad thing that he has done in his past. Maybe God forgives him of his sins, but the new Central Office does not.

He probably has only restrained a handful of youth at Crockett so what "illegal restraints" are you refering to? "Falsifying documents" what documents? If you gave your so called "evidence" to the investigators, hopefully they can read through your nonsense and see that you are just another disgruntled employee that quit or was fired because you couldn't or wouldn't do your job. As stated earlier in this blog, Blu passed the polygraph on all of this. So be honest with yourself, Bubba, you are making up a bunch of crap. Maybe you should take a polygraph and the investigators can compare your results to the one that Blu passed.

The truth, oh yes, Freeman and Blu are "lying and cheating, bastards". Maybe they should be appointed Conservator and Executive Director. My loyalty is not to the "One Team", nor Freeman or Blu, but rather the youth that I have dedicated my life to work with. You can call me a Blu supporter, but you obviously don't know the Blu that I know. In regards to your comments about hundreds of students and staff knowing the truth, the truth is that most of the current students and staff want him back at Crockett. In regards to Freeman, most are glad he retired and should have done so long ago. Hope you can find something better to do with your time in your new found "professional and successful life" than to continue to spew lies on this site. Congratulations on quitting, staff and students don't need someone like you, just by the sounds of your comments, you must be a very unhappy person. TYC has been a very good job for me, and I will continue to work for the youth in TYC. Enough about Freeman and Blu people need to focus on the real issue. Crockett State School is a major employer in Crockett and it is going down hill. TYC executive leadership has proven that they can remove Supts, but can they replace them with effective leaders. If so, get one to Crockett asap before the place goes further down the toilet.

I was a student at Crockett State School ( Courage 1 dorm). I have to say...Freeman was a monster and guilty of many unforgivable wrong doings, so were a lot of his goons. I've heard his disgusting sexual conversations a few times with female employees...."bonuses for favors" as they loved to refer it as. Lets not forget that fiasco with Allison Brewton and a student on her dorm, staff dishing out emotional abuse and discrimination to gay students, female employees making passes at inmates and peeking in the showers in the courage dorm pods. Also years of emotional, physical, and sexual abuse. I was there from 2000-2003 and I've seen Crockett go to ruins. I never could fully recover from the abuse and form a happy life. It was hard to let go and move on. When I heard they shut it down...I cried tears of joy, knowing kids wont be subjected to the hellish nightmare I've endured. The only decent people there that actually cared about students were Tracy Painter/Wagner, Mrs.Lockheart, Mr.Ghandi? (Old gym coach), Ms. Leslie Hammond(she changed my life. I owe my success and betterment to her). I know this thread is old and my post is probably silly to some, but with the closing of that place, I feel I have closure and can finally continue life happy. I nneded to have a voice in this. Thanks for this thread, by allowing me to do so.
