House budget writers move prison guard raises to "wish list," Senate cuts 40% from TYC budget

Corrections budgets hit the fan today in both chambers of the Texas Legislature. Reports Mike Ward on the Statesman's legislative blog:

A House budget subcommittee this morning tentatively agreed to drastically downsize a proposed pay-raise package for Texas’ prison guards, and move it from the sure-thing budget to the wish list.

State Rep. Debbie Riddle, R-Tomball, the chairman of the subcommittee, said the panel had little choice but to reduce the requested 20-percent raise package to just 5 percent.

That cut dropped the price tag from around $450 million to $124.8 million.

And because the state’s regular budget is so tight, Riddle’s subcommittee agreed to move the 5-percent raise to the state’s fast-growing “wish list” of items that should be funded, if extra money can be found. Subcommittee members said they will label it an “important, high priority.”

Not too promising, though in the current budget climate perhaps unsurprising. I'm not sure a 5% bump will be enough to overcome TDCJ's staffing shortages. No doubt, this decision to de-prioritize guard raises will be a major topic of discussion at next week's TDCJ employee lobby day, sponsored by AFSCME.

Meanwhile, TYC got an unexpected budget shock this morning in a Senate Finance subcommittee hearing, reports Ward:

Citing a need to cut operations costs at the Texas Youth Commission, whose incarcerated population has dropped by almost half in two years, a Senate budget subcommittee moved Wednesday to possibly trim the agency's proposed budget by nearly 40 percent.

A youth lockup in Corsicana and half of a juvenile correctional complex in Brownwood could be shuttered under one of four budget-cutting options proposed. An agency proposal to build three new lockups in urban areas would be scuttled.

Does it make sense to close TYC's main mental health facility when a majority of the TYC population has mental health issues? Just what is all that money going to the counties going to buy - a $20 motel room, a baloney sandwich, and a copy of Better Homes and Gardens for a treatment program? Are youth going to get four hours of education common to JJAEP's or the seven hours required by state law for TYC? I have yet to see a detailed anything that would tell me the cheap way is comparable to TYC. Are we getting a new Cadillac or a used Yugo for this money?

Not a lot of what is happening to TYC makes too much sense.

The Leg is talking about the population within the agency decreasing by 1/2, but the youth to staff ratio has changed from a typical 14:1 to a now 12:1, along with the youth to caseworker ratio changing from a typical 28 - 30:1 to a now 10:1; giving you more JCOs and caseworkers per dorm.

Other changes were made to TYC that accounts for more staff, for example, regional managers, youth rights investigators and more IRD staff to not only take care of the additional computers, but also to manage the large scaled camera system that has been put in place, not to mention more cameras are on the way.

Downsizing the agency just means less quality care for the youth sentenced to TYC... not good for the state of Texas and it's neighborhoods.

Better think long and hard before too many more drastic cuts are made to the system - it impacts us all in one way or another.

You know what this means? 40% is what, about 100 million? And so how are we supposed to provide services? What do they want us to do, warehouse these kids?

It seems to me this is a Whitmire power play to get Cheri to back off the opposition to the merger. I can tell you right now, his statement that as of today, about 1200 kids in TYC facilities could handle a third shot in community based treatment programs is very inflated. I think that maybe true for about 2-3 hundred, and about half (probably more)of those came from counties that had no post-adjudication centers in their communities.

How could the stimilus money help this problem? I have my ideas, but I want to hear yours.

6:57, not sure what facility that you are at but the recent caseworker riffs made most of the caseworkers at our facility 1:16, unless you are CD caseworker and then you have 1:8. It makes it hard with the new conextions program.

On a side note GFB, I want to add that I'm watching Will Harrell on cable TV talking to "Ruth" about TYC and it's programs. We sure broke Will in good, and he's hitting the issues we face right on the head, and now he's "scary knowledgeable." He has been a voice of reason, and a hell'uva Ombudsman for this agency. I guess this is an ACLU channel. But he's a great fighting Ombudsman. Will sounds like he's been watching TYC for 20 years - not two. He's really got a grasp of the problems.

Campus size should not exeed 100 at any location. You will be able to staff and have security then.
The major increase in facility size (bedspace) and capacity has created the mess you see today.

Partially true, however; how can anyone justify the spending of this outrageous amount of money? TYC ledership has not shown any real desire to work with the lege, and feels it can spend freely without consequences. Big surprise!

I can't believe all the complaints about the cuts and the possible facility closures. This has been coming for the last two years. Have the TYC employees had their heads buried in the sand? This will not be the only cuts. Expect more, until there are only 2 or 3 facilities left. Update the resume, and get out while the getting is good.

Yup, West Texas will completely close now; Vernon, Coresc, and Brownwood are next. Giddings is the only safe facility, the lege likes to make trips there and be seen 'working'. Pack up and get ready to move....Austin has let you down again..and again...and

The word here is Gainsville is to be cut also. When will we know for sure? We don't want to follow the steps of Crockett and West Texas. Evins needs to close, its so dangerous and out of control, but help us here at Gainsville. WT sealed its own fate, but we have done much for our youth.

I very confused. Those folks alleged that TYC failed to provide services to the youth. They basedtheir assertions on reports from people and agecies that have nothing to do with TYC,and knew little about. They distorted data to support their claims. They calimed that TYC was failing to serve youth with high mental health needs, special ed youth, and sex offenders. According to them, TYC did nothing but abusethe youth. If they believe what they say, they don't show it. Cutting the budget 40% will ruin them. Already they are short amny employees. They won't be able to provide services to anyone child. Obviously, if they expect TYC to take the worst(which they already were) they will certainly need to be able to deliver services.As acitizen of this state I am offended and appalled by their behavior. They had an agenda that had little to do with the safety and well being of the youth. If I am wrong, convince me. They act like TDCJ is much more important than TYC. TYC is way, way short on staff. What about the 12:1 ratio? TYC needs many more direct care staff than does TDCJ.
I urge all of you to do a little research about what TYC was providing for the youth. Please go to those who know. I know for a fact that TYC offered all of the services that those people claim they didn't. They played with numbers, and just launched a full assault on TYC that was teribly underseved. For two years the youth and the staff have suffered due to their reckless actions. I would like to know what they think they are going to do now. Those kids really will be getting nothing and it won't be TYC's fault.

As much as I thought tyc could be saved I am sure now that the ledge will kill it.

Where will all the kids go?
How many will be tried as adults because parol is to booked to take any more?

I hope the state has some cash in the bank to pay out the billions in lawsuits and possible Federal oversight that will result by giving the prison officers only a 5% pay raise. TDCJ Officers are ranked number 48 out of 50 states in correctional officer pay.

Texas runs the most violent prison system in the US. The Feds are eying TDCJ for PRIA violations and other safety issues. It is sad TDCJ can't even staff their prisons even in the middle of a recession. The house is asleep at the wheel on this one.

As a taxpayer $456 is cheap compaired to the billions Federal oversight would cost. TDCJ was under it once and history is repeating itself again.

IMO, little actual mental health treatment is provided at Corsicana, and even less so recently. I don't think that facility should be on the chopping block, because it's better than nothing. However, if anything, that campus needs a big boost. The psychology department there is taxed to the limit. The department has dwindled in numbers, and those remaining have little formal clinical contact with the youth. It's a mess.

Most of the youth in TYC have significant mental health issues, but clinical staff across TYC facilities continue to leave in droves. That does not bode well for TYC youth, regardless of what grand plan the lege or anyone else has.

Would you stay knowing you are going to lose your job?
I work in corsicana and was hoping it would be spared but I now know it is a losing battle.
There is nothing that can save it and very few are even trying to save it anymore.
People just working until the can draw unemployment.
It is sad it has come to this but I dont think there is a campus that does not believe they will have jobs in a year.
I cant imagine how bad the last few months will be and how much the kids will suffer because of it.

If you have not watched those sessions, your missing out on what is really going on.

People that don't even know what a JCO is, they said JNCO referring to staff. To think these people are determining the welfare of the kids and people who work there. Now this is sad to make a decision and your clueless to what your deciding on, only except some budget or figures on a piece of paper. Don't know the difference between TDJC and TYC.

The biggest funny of them all is when one memember ask if Pyote was the one that got hit by the Hurricane! This happen last week at one of the meetings I was viewing.

Cathy ~ offenders whose crimes are non-violent are way more likely to reoffend in the first 12 months after release. Releasing them all would just create a bigger problem a few months down the road. Plus, there are plenty of inmates doing time for non-violent crimes who are extremely violent while in prison. Dont let the lable fool you.

Get the BPP to consider each case on its merits and you could release a good portion of inmates with non-violent crimes on parole, but not all. You could also release the inmates who are costing the state millions of dollars each year in medical care but whose families are willing and able to fund the treatments themselves. Release on parole those who are aged over 65 unless there is a very good reason for not doing so. Use electronic monitoring more widely for those groups and not for young people who would on the whole prefer to do their whole time in prison.

Fewer inmates should release funds for CO pay.

I am really concerned about what we will do with the extreme mental health kids if they close Corsicana. As a caseworker I have not sent many to Corsicana but the few that I have sent could not function in a normal TYC setting. I appreciate what the staff at Corsicana are able to provide for these kids. What is being considered for these youth if they do close Corsicana? IF we place them in general population on a regular campus-they do not function well at all.

We too have seen a jump in referrals. I have almost double the number of kids awaiting disposition with a TYC rec. The plans on the other article are a great concept but privisions need to be made for those counties that see a increase in felony referrals. TYC is about to get some of our county's finest citizens, should send 4 next week or 2 and another 6-8 in next few months.

I am smaller county that used to send 6 to 8 kids to TYC per year. The last two years we sent one and then 2. Felony referrals to juvenile court went from 42 in 2007 to 76 in 2008. I have heard this trend from some other counties.

This is why I consistently advocate for the State to just go ahead and fix its' isues at TYC and stop trying to change the structure of the juvenile justice system.

ATTENTION SCOTT HENSON I just read HB 1893 and it's co-bill SB 1164. Both these bills are wanting to allow concealed handguns on college campuses!!

This is outrageous and should not be allowed. Call/write your Legislators/Senators and ask them to vote against this bill. This after all is not Virginia Tech and handguns should not be allowed on college campuses!

Youths will continue to be referred to TYC at nominal rates. The legislature cannot tell local judges where to send troubled or criminal youths without offering monetary incentives to local detention and treatment programs.

The the fiscal obliteration of TYC, you will see that troubled youths will be warehoused without proper treatment and by low paid guards.

TYC will fill up and will have no choice but do the following:

Send "excess youths" to private facilities, release them, or place them on parole or probation with no real threat of incarceration or incentive to complete treatment programs.

With an overcrowded, under funded TYC system you will see more prosecutors seeking adult certifications and more youths entering prisons operated by TDCJ or a private contract facility overseen by TDCJ.

You will continue to see arrests in TYC by the OIG due to drugs, sex, and whatever other consequence is wrought due to the shoddy background checks that are done on the people that are guarding the youths.

I hate to say it as a Texan, but the law makers, leaders within TYC and the Texas people simply do not care enough to make the Texas Youth Commission what it should be.

The Texas Youth Commission should again make public safety their first and foremost concern above any other mission.

The Texas Youth Commission should protect its staff by performing real background checks that are not just criminal histories but to where their past employers are contacted and their moral history is compatible with the agencies' goals. This requirement should be coupled with a generous compensation package for staff members.

The Texas Youth Commission should also give their staff members a use of force policy that allows the staff to use nationally recognized defensive tactical techniques so that they can defend themselves and the youths they serve. This use of force system should be easy to understand and accessible to affect staff. If the staff act properly in the use of force, they should be protected and if they act improperly they should be held accountable.

Youths that are violent need to separated from the general population. With the disappearance of the Behavior Management Program and the Aggression Management Program violent youths can only be detained for a very short period of time. Violent youths cannot be disciplined or separated from the general population anymore which allows sexual predators and violent gang members to enslave other youths. We must regain control of our facilities before treatment is even an option!

We need to create more incentives to keep treatment personnel applying to TYC and need to ensure that psychology residency programs are national recognized so that young mental health professionals can advance their education on the job and be recognized for it.

We must stop reducing our force of case managers which are a crucial component to treatment of trouble youths.

We must make TYC classrooms safe by have a zero tolerance policy for disruptions. Teachers should be protected from assault and inappropriate behavior. JCO nor security personnel should not question a teacher's decision to eject a youth from their classroom which is right afforded to all Texas teachers. The reintroduction of a youth to a teacher's classroom should be a mediation process between the teacher, youth and the principal in accordance with the Texas Education Code.

Youths who have proven that they are not a threat to their communities should be evaluated for early release making sure that it is in accordance with the instructions of the referring court.

Youths that are still dangerous should not be reintroduced into the community. That is why OIG needs to be able to hire more criminal investigators than they currently have. The average criminal investigator has over 150 criminal cases on their case load. This number is unsustainable. There are also many administrative issues that cannot be addressed quickly which is why OIG needs the ability to hire more administrative investigators. OIG also needs to be an independent law enforcement agency so that they are not bogged down by agency politics of which they currently are affected.

TYC record keeping needs to be more streamlined an in keeping with computer advances. Behavior logs and other disciplinary infractions or serious offenses could be digitized so that a better more individualized treatment plan can be created for that youth. Record keepers need to be immidiately responsible to law enforcement agencies, judicial agencies, legislative inquiries, and advocacy groups in accordance with state and federal law.

If TYC was able to do the above things, the system would not be perfect but it would be far better than the one that we have in place now. The system is run by quarreling gangs of youths and not by the State of Texas.

The above things will never come to pass and youths that could be saved from criminality, the prison system and untimely demise could be prevented. Youths that did not enter the system with a complete criminal mind will continue to exit with a penchant for violence and criminal acts. We must end the cycle of violence by youths against youths, staff and Texas citizens.

The lawmakers, the TYC administration and the citizens of Texas simply do not care enough to fix the system, only to make it cheap. Often great solutions do come at an expense.

I go to work everyday thinking, "I did not create these problems, I know I can't fix all of these problems but Lord I am trying to do my part for the greater good."

9:43 p.m., when a state agency becomes a political consternation at the mercy of a couple of bully politicians, ignorant of the mission of TYC, nothing will be accomplished. Whitmire seems to have a personal vendetta against rural communities in Texas and it looms "Large" in his mind. It makes a person wonder who he really wants to get at. Is it the rural community that he portrays as having ignorant and uneducated citizens or the elected officials who have them in their districts that he really wants to get at?

The citizens of the rural communities should be protesting at the steps of the captial. My childen were raised in a rural community and turned out to be a lot smarter than Senator Whitmire. His personal agenda against TYC is going to hurt the troubled youth of Texas. As a private citizen of a rural community that houses a TYC facility, I am ashamed that we such a bully of a senator in our government.

As I follow the unfolding drama of TYC, I encourage the few politicans that are honest, upstanding and dedicated to rehabilitating youth, to outvote him and provide the funding that TYC needs to help these youth.

You CITIZENS in Harris County, don't forget you have rural communites also, when it comes time to VOTE make yours count & DO NOT RE-ELECT WHITMIRE!

I sit here and wonder if one of these youths were to victimize him, would he feel the same about letting them lose in the counties to re-offend again?

11:09, Believe you need to learn how to read. I'm asking for TYC to be funded and the politics left out it for the sake of the kids. Nothing less, nothing more. You can't rehabilitate youth without money or trained employees. How does that make me want my friends to keep their job. Much to your dismay, I don't know anyone working at TYC. I'm a retired person. However, I have been keeping up with the saga of TYC. How can I not with it hitting the media daily? Perhaps its you that should go away, you aren't posting anything constructive to the conversation nor contributing anything positive.

How many of the 310 Central Office staff will be rif-ed? Whitmire said it was a "bloated beaurcracy". Do we really need such positions as "Space Planner", "Legislative Liason", etc. And perhaps the Lege should look at the amount of money and resources are expended on travel for regionalization.

Its true...there is much fat still at West Texas and most TYC sites. The state needs to really get rid of this fat and return to helping troubled youth. Central office has always been overly fat, and even Cherie is afraid to rock the boat there. Those people have earned their right to stay fat.

12:30 p.m., Central office has 310 employees and you are saying they have earned the right to be fat? What rock do you live under? TYC has been reduced in population and downsized to the bare knuckles, how do you justify the same number of employees in central office?

West Texas has been reduced to a 48bed facility and JCO's were demoted. They will lose 67 actual bodies on March 31st, including 6 clerks, warehouse supervisor, laundry supervisor and an HR clerk. You make absolutely no sense, enlighten us?

Central office has to have certain positions to effectively control the TYC resources. Sadly, cuts must be made somewhere and the field staff are easier to sacrifice than deeply trained central office employees. They keep the system going, whereas field staff - WT/Vernon/Crockett/Gainsville/Evins/Brownwood can be manipulated as needed for the big picture. Some have to be in charge and insure the show goes on. Again, sadly to some, some have to give for the overall show. Thanks for your understanding and support.

Yes, go ahead and shut down TYC. Infact go ahead and shut down everything. When this little angels move next to you and your neighbourhood just don't be afraid. They will not make crime worst. They will not lower the value of your property. Don't go out and but a gun or hire security to protect your homes. Infact we should just bottle this and send it to the rest of the world. We all seem to know what is good just because a few people made TYC to look bad. Infact we should all be labled the exact thing when the media writes that such and such crime have been committed at such and such county. This is what eveyone is doing nayway. We lable TYC for a few bad apples so why not do it when crime rates have risen in Dallas. Maybe we should blame it on Bush and now Obama for all our problems. they are our leaders at one time or another. We should call ourselves murderers because we send out troops to fight. All we are good for is to blame it on someone else. We all forgot what Whitmire have done in the past and now that his is not going to run for office why should we care what he wants to do. he has not worked a day in his life as a JCO. I bet every meeting that he attends that we have to foot a hafty bill for him out of our tax paying expenses. Everything looks good on paper until it's put into work and it falls apart. Like I have said, it it's such a mirrical drug then we all need to package it and send it to the rest of the world. Just start small and send it around to the rest of the states. I rest my case.

Central office staf are crucial to the management of the entire state. We must be properly supported to insure the vavious institutions function well. Ant organization has to have a well-supported head team, which we are in C.O. Quit the gripping and start to support the whole program, unless you want the public to demand more rif's. One of them has a brand new baby and a five year old. The whole sordid mess stinks and you are defending central office!

Personal responsibility starts at home. Almost everyone knew big changes were coming for the past two years. If some failed to plan properly...have kids, buy new cars and homes, that says a lot about those people's ability to plan. CO has lost employees also, don't act like the field is better or should be exempt from rif's. Get over it.

3-13/11-22 am, the field has already been hit hard with RIF's. Get out from under the rock you reside in. I'm in awe of your compassion and empathy toward the RIF-ed employees. What can mankind expect from you in dire circumstances, what a shame! I pray you aren't my neighbor. May the responsible person that you are, Not find you in the unemployment or soup line tomorrow.

I understand county dentention centers are imploding in population. So much so, that youth are sleeping on floor due to lack of beds. For TYC, it's a matter of pay me now or pay me later when beds are scarce!!!

TYC may have also reveived pay raises, however, once it became known how much waste was taking place in TYC - 99000 per kid...wow...how could anyone merit a raise under such terible manangement conditions?

It's the lege that needs to scapeled. TYC is in the mess it is because they failed the agency and the troubled youth of Texas. The systemic disease went way up high and they buried their heads in the sand, like emus. The people that re-elect them should be ashamed!! IMO. Archived broadcasts do not lie!

Watch out for TYC's policy about RIF's. Wood-HR Director wants to change it to protect the TDCJ transplants. It is now based on TYC service, she wants to change it to be based on state service. So that it can benefit her friends from TDCJ over long-term TYC employees. Keeps you eyes open for it.

I agree with it being state service. Many employees transfer from on agency to another. It would benefit everyone that decided to go with another state agency.

Looks like the cuts are not doing so good, 1 Youth in Crockett committed Suiside today and Brownwood had a Big Riot due to a Student sexual assult,, Oh that was a Student on Student Sexual Assult...There was talk in town from a guard that during the riot They called the asst super and She advised them they could handle it!!!! Now I see we have a problem in Brownwood.....Doent that say She is neglect of Youth ?????Someone needs to address this issue before someone gets hurt ...or worse than that look what happened in crockett..
