This is approximately 1,000 a week. During Judge Rosenthal's preliminary injunction (which was just reversed), the failure to appear rate of people ordered to be released without any surety was approximately 50%. This means that if there was no private surety, then every week 500 cases would have to be rescheduled awaiting for the defendants to return to custody. Then the next week another 1,000 people are arrested. She held that the use of a bail schedule, coupled with no hearing available to ask for a deviation from the bail schedule, was a violation due process and equal protection, as applied. Therefore, Rosenthal did not order the county to get rid of their bail schedule. The 5th Circuit reversed the preliminary injunction issued by Judge Rosenthal. The court of appeals confirmed that the use of a bail schedule was constitutional. There's a reason Republicans in Texas have majorities in both legislative chambers and hold every statewide elected office--and it ain't because the public supports the coddling of criminals .
