There's not a week that goes by that I don't dismiss a case on 4th Amendment grounds. Proclamations that "the 4th Amendment is Dead" are backward, stupid and flat-out wrong. "unreasonable" searches and seizures is the standard, and as new technology evolves, we're going to be confronting different situations.<br />No, the 4th might not stop an overzealous cop from searching your stuff or taking you to jail. But it will still keep that evidence out of your prosecution. Just because the 4th doesn't mean exactly what you wish it would mean, doesn't meant that it's "Dead". While this is admirable for those who put such trust in the government, let me remind you that in our system of justice, especially in Texas, the State will use unlimited $$$$$$ and resources to pursue and prosecute you if they think they can make a case.<br /><br />At the rate we create felony class crimes, place due process in the swamp and allow judges to act as sitting prosecutors, this puts everyone in peril. Count me as one of those sounding the alarm about the death of the Fourth Amendment and the growth of the Big Brother, Prison-Industrial Complex.
