It is of paramount importance that any prosecutor or court in possession of such information report it directly to the defense counsel and to the defendant. This is a no brainer people. How in good conscience could this question even come up? Our Nation was founded on principles such as these. To even allow the state to consider that it would cost a lot of money or that it would backlog the courts is ludicrous. I cannot for one second believe that in reality there are intelligent people who are significant members of the governmental, and judicial branches of government that would actually ask that question. (Does it matter whether the lawyer did or didn't challenge the evidence at trial?). Does the lawyer have an obligation to do more, such as ask the court to appoint habeas counsel, or ask the DA to reexamine the case? Now they are as unsavory and dishonest as the BATF and the DEA. My personal view of them changed when I read how they tried to frame the Hutaree, members of a Michigan "weekend militia" who were rounded up and presented to the public as homegrown terrorists who aimed to start a war by killing police officers. Miraculously for these militia members, the judge appointed to their case saw through it and dismissed most of the charges. <br /><br />Scott, I have just finished reading "The Rise And Fall Of The Third Reich" for the first time since I was required to read it in college some 30-years ago. And the parallels between our country now and Germany in 1937 are many, and undeniable. The Nazis were the first to create a Homeland Security, and it eventually had authority over all other law enforcement agencies and finally evolved into the Gestapo. <br /><br />"We The People" are no longer in charge here, and we aren't going to be able to change anything at the polls.
