New TYC rules make more kids eligible for release

Several new rules just took effect at the Texas Youth Commission that have received little attention and surprisingly no public comment since they were proposed in April. According to the Texas Register, Governor Perry's now-departed conservator at TYC, Jay Kimbrough, received no public input regarding several significant changes to the Administrative Code governing the youth prison agency.

For starters, the changes make it easier to release TYC kids even when they haven't completed various programs to which they've been assigned. It:
gives the Director of Treatment and Case Management the authority to grant waivers for certain youth who would otherwise be required to complete the chemical dependency treatment program, sexual behavior treatment program, or capital and serious violent offender treatment program in order to qualify for release on parole.
The new rule also reduces "the amount of time a youth must remain free of serious rule violations in order to be eligible for release on parole from 90 days to 30 days." FWIW I can guarantee you that change alone will dramatically increase the number of TYC youth eligible for release.

Another amendment gives TYC carte blanche to release kids into virtually any setting, giving:
the commission ... authority to release under supervision any child in its custody and place the child in his or her home or in any situation or family approved by the commission.
Finally, a new rule puts in place safeguards to ensure abuse investigations aren't prematurely closed or that supervisors don't ignore the results. The change:
requires that an officially closed report include: (1) the signatures of the supervisor who was responsible for making the final closure determination and the investigator who was the author of the investigation report; and (2) a statement by the supervisor if he/she disagrees with any portion of the report.
Often changes to the Administrative Code have as great an impact on criminal justice programming as changes in actual statutes, and IMO these are as significant for reducing overincarceration at TYC as anything the Legislature passed on the subject.

A lot more rulemaking must occur at TYC once SB 103 and other pending legislation becomes law, though the commissioner is the sole "decider" under the current structure - there's no longer a TYC board to have a traditional rulemaking process. A handful of other agencies like the Department of Insurance have a single commissioner who makes agency rules by him or herself, but that still makes the process pretty insular. It's astonishing in this case that with all the hoo-ha surrounding TYC this spring the agency received no public comments on the changes. That must be at least partially because the board had been disbanded.

  1. I am wondering how long we will have to wait until the state of Texas starts to feel the pains of letting all these youth home. As we saw on the nightly news last night, crime, especially violent crime, gangs are now increasing. What then, in two years are we going to put TYC on the hot seat again if all crimes increase in Texas? While I agree some youth need to be released, but remember everyone, most the youth that are going to TYC after this session will be even worse than before. What is going to happen when a murder or rape happens and it is a youth that did not progress in TYC but his time was over, who is going to be able to explain that to the victim's family so they will understand? As it looks, we have all but eliminated the rehabilitation aspect of TYC, so why do we have it? We have destroyed the chance we had to maybe change some youth, now we are just a juvenile version of TDCJ. As the violence climbs in the institutions, the turnover will rise, the injuries will rise, the moral will fall. It is a very sad for the state of Texas. All of this because the legislature would not own up to being informed of the abuse in WTSS two years ago, so they strong armed these changes and left many innocent victims in their wake. As I see it, Mr. Brookins and Mr. Hernandez's actions continue to victimize the youth committed to the Texas Youth Commission. How ironic will it be if these men get away with it, and we fired people with petty crimes or crimes committed years ago.

  2. The staff who had direct knowledge of the abuse that occured at the West Teexas State School have not been held accountable by the law.

    Mr. Dwight Harris, the previous Executive Director retired from his position with a full pension, so did Dr. Linda Reyes,Assistant Executive Director; but several staff were fired for crimes they committed in there youth; but since turned their lifes around. Most people do not want to work with youth, Lord knows it not the pay; but a sense wanting to help someone change there life!

A monster has been created in our juvenile justice system-- one that has just been born; and when this newborn mess reaches maturity, everyone in Texas will be affected, especially the future victims and John Q. Taxpayer.

  5. As a staff with TYC it is going to be fun to watch all these youth going back to the community. You may want to lock up your kids and sharpen your shooting skills because these kids can't follow the rules of society, and they won't care about the rules when they are released. Too often the kids themseleves will tell you that they don't care, and will do what they want. Personally I feel that if the US Supreme Court spent any time at one of our facilities, they would never over turn Roe V. Wade becuase these kids the worlds biggest support for abortion. It is amazing to me that know that the lege is out there is no one around to feed into the overblown, BS hysteria that has been going on at TYC.....

  6. To commenter at 8:30 p.m., I hope you are being dishonest about your being a member of staff at TYC, because you suggest that kids who are chosen to be released deserve to be shot, and that all the kids in TYC should have been aborted.

    If you're not being dishonest with fellow Grits readers about your employ, maybe you are being dishonest with both yourself and everyone else at TYC if you claim to care about the children there. You have expressed a terrible, terrible sentiment not only as a "child care provider," but as a human being.

    Are you a role model to children in practice and spirit, or in your own head, alone?

  11. TYC has been gutted! It is a dieing agency. When the TYC system implodes under the current leadership the contract care companies will be there to save the day. This has been about money from day one! The current administration cannot be this stupid. I believe this is a very carefully planned operation to take TYC to a contract care system. Rick Perry has sold everything possible so why not TYC? Kimbrough is Rick Perry’s man and he will do what ever is asked of him. Kimbrough has been given a very high level job at TAMU as payment for his highly skilled work at TYC. When things don't seem right follow the money. Only contract care facilities could benefit from the current management model. I have never believed this was about the TYC children. It is about DOLLARS and nothing else. For the sake of your families and yourself, I think most current TYC employees should start looking for a new place of employment! You will not be allowed to help the TYC youth make the changes needed to turn their lives around. You will be in a very dangerous work environment. Think about where your family will be if you are injured on the job. TYC will not take care of you or your family; that is your job.

  13. @9:57 - Dimitria Pope is another TDCJ transer, a former parole officer who became director of research at TDJC and is now TYC's chief of staff. The TDCJ staff and advocates I've talked to who know both tend to respect her more than her boss Ed Owens, FWIW, though I've never met either person. She advised Whitmire, Madden et. al on the legislation this session (along with many others).

    I hadn't heard the rumor she would be the new commissioner after Owens, but it wouldn't surprise me.

  14. For those of us that work in TYC, we can tell you the storms have just started, and I am not talking about the weather. Youth are showing no respect for staff or each other. The kids in the halfway houses show no respect, we can see our facility going to crap fast. The boys have had fights and the acting supt has done nothing to them, I thought the cops were suppose to be called. She just watchs as the kids cuss us out and does not say a thing. At least our supt backed us up. And these are the kids we are releasing home, it is scary isn't it.

  15. The characterization of the incidents of abuse at WTSS has never been accurate. When the events occurred it was all over the local media. Mr. Harrison asked us not to speak to anyone but the investigators, but encouraged us all to cooperate. Lydia Barnard came to the facility and apologized to us for hiring Brookins as Asst. Supt and putting him in charge. We all expected this to become a big media event, but it didn't. Seems like the incompetence at the time was with the MSM for not picking up on the story back then.

    Dr. Reyes and Mr. Harris were hard working, intelligent people, who were part of a mistake. For a cover up to be a crime, there has to be a crime to cover up. Brookins and Hernandez have not yet been convicted, except in public opinion. There is a real possibility that they are actually innocent. The students at our facilities are not all monsters, but they're street smart, and they will do what they have to do to survive. This includes corraborating lies to get rid of staff they don't like, or to manuever early release. Let's hope the courts will do their job fairly and honestly.

    TYC needs fixing, and I hope we will be able to fix it, but the reality is most of the delinquents are already on the streets. There are approximately 70,000 juvenile offenses a year in Texas, and TYC only took about 2 to 3% of those offenders. Our leaders are trying their best to do what the lege has mandated, but it is true that we need to rethink our whole juvenile justice system in the state.

  16. You sound like someone from CO and not the field. While I agree that the system needs fixing, why are w still getting rid of great staff? Is that fixing the problem? Decisions are made by the folks up in CO without even getting any input from the field, the ones who deal with it day to day.

  17. That's not true. Every reform group I have sat on has had field personnel present at the table, JCO's, case managers, and so forth. Superintendents are picking the folks that they want to represent them, so if you believe CO is not taking field input, you are absolutely uninformed.

  18. I'm not a CO staff. I work at WTSS, but I've been to CO many times. They are a lot of nice people trying to do a job like the rest of us, and that includes Ms. Pope and Mr. Owens. I understand the feeling of isolation, but everyone in the agency has their own agendas, and when they don't get addressed we feel they aren't listening. They do listen, but they can't make everyone happy.

  19. Yes people came to our facility and ellicited input from field staff, but I doubt that this leadership team will use that information in any meaningful way.

    Maybe this is the biggest problem? TYC field staff right now doubt whether the leadership is even there for us. If I were in a leadership position and wanted to build a team, I would bring my staff into the fold, not accuse them of crimes and dastardly deeds without benefit of a fair hearing.

    The future of TYC as an agency will be interesting, but I'm not sorry I will not be part of it as I have resigned my position this week.

    Hell, as of today I don't even know who the leadership of the agency is. They haven't told us a thing about which of the TDCJ cronies are staying and which are going.

    Considering that the appointed leadership implements major policy changes without even informing staff, it is no surprise to me.

    They don't post the changes for public comment or send them out to news agencies, so how is the public to know about these changes to comment on them? And since they implement them before the policies are even written, what is the point anyway?

    TYC employees don't even know who is in charge (and this includes staff at CO), no one is communicating anything to anyone.

    I've gotten more information from this blog than from the MSM or the agency.

    And in the end wasn't poor communication between staff and leadership at the root of the problems causing the agency to implode?

    Here's the other thing folks, those felons and people with past criminal backgrounds "ARE STILL" on the payroll. Go ask anyone of them. Not one of them has been fired for their past criminal convictions. Now, what do you make of that??? I know personally some of the very first ones that were let go, and they're still on the payroll. A couple have already landed non-state jobs and are laughing while wondering what the hell is going on? The only ones off the payroll are the ones they fired for management reasons.... Man I wanna be suspended!

I'm curious to know why nothing has been mentioned about the fact that at least one of the four recently suspended superintendents has been reinstated, because the allegations made turned out to be fabricated, but because of all the hooplala going on in TYC, had to be investigated. Also of note, the person that was fired at the same facility (and some might say the instigator in all the now proven false drama) is still and will continue to be fired.

  26. What has really been brought out since all this started? The reported sexual abuse, with the exception of the case at the Half Way house in Ft Worth were already known about. They were investigated, but the investigators had no authority to file charges, or the DA of those counties would not take charges (ie Pyote/Monhanns) . As a TYC employee I am worn out because of the increase work load, the parinoid staff, and too many of the youth that run and call the hotline just because they want to get rid of staff by making false allegations. That is a common threat going on constantly. Staff know they no longer have support from anyone, and while there are some staff that don't need to be in this job, there are a lot more staff that do care, and are getting hurt because kids will jump a staff and beat them just because they can. I worked adult corrections for almost 20 years, and never in those 20 years have I seen the level of violence that these youth use on staff. Now they are being released into the community, and trust me, their release is not going to stop their violent behavior. I am in the process of looking for another job, because as much as I loved my job, it is just not worth working for an agency, or administrators who only care about the politics and press coverage, and not the welfare of the staff that work trying to keep these kids safe, and from beating each other and staff up.

  32. 9:29, it is a federal crime, its punishable by up to 10 years in prison and i believe that each supervisor involved can be fined $15,000.( Doesn't anybody remember ENRON?)   35. Lisa Cooke is one of the most hated superintendents! How did she get to come back before that poor lady that just used the fed-ex system improperly? That just doesn't seem right, doesn't anybody else find it strange that she was the one they made the big deal about suspending, and they bring her back?? To my knowledge nobody has ever been "reinstated" from this mess...maybe the state has been told to back off because of the feds coming in. This just seems off.

I would really think about you are bragging about, that case is NOT over.I believe Lisa Cooke was found not guilty of crimes against YOUTH, am I correct? It would seem to me that if I was McFadden staff, i would not be planning a party too fast for Lisa Cooke or counting out that person who was terminated.I personally can not imagine wanting to work somewhere like that but if my lawyer told me to exhaust all my remedies so that I may take criminal and civil action against those responsible. I guess i would have to follow the advice of counsel.

  70. I just found out about this blog and I had to come and see people defending Cooke with my own two eyes!! I agree with the person who said, lets take a poll on who is happy that Cooke is back in her position! Lets put it this way, if she was an elected official she would have been removed long ago! It is nobody elses fault besides her's that our working environment is the way it is. But lets blame other people for her bad management skills, lets see here, we have had numerous people removed for touching the boys, we have allowed Cooke's bad management ruin our moral for too long. Lets just say, if this was an election she would lose. She should go ahead and retire and let McFadden have a chance at being a normal facility, she should take her bunch of misfit supervisors ( with the exception of ONE who does his job VERY WELL)and move on like Howard Hickman said today in his email, know when to fold em Cooke.

We should feel sorry for her.She has taken a business and made it very personal.As far as the person she fired ( still and will be continued to be fired) thats some pretty strong statement for somebody who doesn't know any better. I would be willing to say, if that person isn't reinstated, its because she would choose not to be and can any of us say we would balme her?If you ask me, she is better off than any of us, she will get this settled and with any luck NOT have to be in this environment anymore,it isn't a nice place to work.

  74. Just so everyone will know, our supt, the fed ex one, is not back. We want her back, our program is in shambles. The kids are rude and the acting does nothing to back us up. She and the other front office people order us around while they sit around and visit and laugh. We want our boss back, we need some leadership in our facility again. I hope she is back soon.

This whole thing seems so inconsistent.It doesn't really matter if you are guilty as hell, they will reinstate you if you know the right people or the right thing to say.With Cooke back at McFadden, my point is proven.Come on people, she was gone for a month, they don't do that for no reason or unfounded allegations, something happened.Lets hope the state moved out of the way for the feds to move in. Don't lose hope people, if she does stay, she is like the captain of the titanic, she is in charge of a sinking ship.

    To be found not guilty there has to be a trial, in court. Lisa Cooke was not on trial. She was suspended pending the investigation for allegedly "interfering with the reporting and investigations of incidents at the facility." Those allegations were unfounded in the investigation.

    There were never any allegations of anything inappropriate with the youth at the facility.

    So, it seems I do know what I am talking about because Cooke was reinstated and the person fired, is still fired.

  82. Ok let's push the pause on McFadden. To answer your question 9:20 PM, yes it is Eric Young, ADED of HR and Karen Giles also. Word is that Eric begged Dimitria Pope to let him "resign" and to take his personal leave. He's technically on "leave" if you call over there, but check it out--he's not on "leave" folks,--that's right, he ain't comin back. Don't know about the fairness of allowing him to take leave instead of immediately being fired, like other executive council members that were terminated with NO notice. Things are such a mess in HR-and it is not because of single individuals, as many of the HRAs are hard workers. Leadership was the problem. Look at the HR breakdowns in San Saba, West Texas, the failed employee discipline system that allowed for promotions of administrators such as Chip Harrison, missing information HR files, and the most recent finger pointing of Jay Kimbrough right back at Eric Young for slipping by him a policy that HE didn't intend...something had to happen to allow Will Harrell to stay in his job, right? They are trying to keep this under wrap--he's on "personal leave"--yeah right--he's so worried about losing his job that there is NO WAY that he would ever go on any "leave" unless it was forced on him.

    I'll miss Karen--at least at her core, she was a genuine person of good character, not someone like Eric that earlier in the blogs was depicted as "brown noser"--Eric, if you are reading this, you really damaged your credibility with state employees and have incredible difficulty finding a job in HR given your disreguard for what you knew was and is outside the law and policy and reputation this agency has of sky-high employee turnover. You gave the media policy that you knew was unfair--just doing what you were asked/ directed to do? Right, be someone of noble character and admit that you did what you knew was wrong and you hurt hundreds of dedicated employees who had NOTHING to do with West Texas. You can blame the leadership put in place, but you carried out all the orders without question or advocacy. And you call yourself the Executive of HR, or at least that's what you were supposed to be. Eric, you never took a stand against what you knew was wrong--in your gut and in the middle of a sleepless night, you know that to be true. Well, let me tell you, you will have many sleepness nights, you will have trouble finding state employment given this agency's damaged reputation and your tainted employee record. You may walk as having "resigned". You may walk having talked YOUR was into being codes as "eligible for rehire," but I truly believe that you are now getting what you have sowed for STATE EMPLOYEES, but the best is yet to haunt you as you seek state service to finish off your retirement eligibility. I wish I could wish you well, but all I can say is that you have received what you well deserve--only you received better treatment than other TYC employees that were of much higher character than you. I pray that some day-you repent for what the terrible detruction that you have allowed to so many of your friends and to employees you were in a position of leadership to serve.

I will do the math since that seems to be your "key" phrase.Hmmm? 1 good person removed 4 bad people, 1 returned because of some unknown reason that might be explained by the federal indictments issued on Thursday morning out of Denton County to be delivered to McFadden Ranch. McFadden Ranch is a drug and alcohol halfway house in roanoke.Does anybody have any information on their recidivism rate.I have heard that 2 inmates escaped from there about two weeks ago, and they only found one.Maybe they were being abused and they ran away?From what I see on here the staff are so busy fighting with each other, the youth in their care seem like they take a backseat. Just my opinion.

  105. Ed Owens,new conservator + Dimitria Pope, new "acting" executive director = the death of TYC. While we are all busy fighting among ourselves (an age-old strategy known as "divide and conquer", these two TDCJ stars are systematically gutting the agency and preparing to morph it into the TDCJ minor leagues. By the time we wake up and realize what they're doing, it's going to be too late. And as it has been so eloquently pointed out, the entire State is going to have to pay the price.

    Earlier, Grits made mention of the fact that this whole TYC debacle might have been no more than a "media circus". I think that's an accurate assessment, but it goes much deeper than that. From Governor Perry, to the AG's Office, to Senators Whitmire, Hinojosa and Madden,etc., this "media circus" was designed to deflect scrutiny and media attention away from the fact that all of these "righteously indignant defenders" of the juvenile justice system knew what was going on and chose to do nothing.

    With the Governor signing SB 103 yesterday, a new era in juvenile justice in Texas has been ushered in. Along with the announcement of the new "appointments", came news of "regional" meetings with TYC staff to finally (maybe) provide something akin to an explanation of the agency's new direction. I wonder if the reason for regional, instead of facility meetings is nothing more than a ploy to limit the number of staff that will be able to attend and ask questions? Maybe they'll finally get around to being truthful and tell us that there's no money budgeted for John Shero and Marlin after August 31 of this year and that their plans also include closing Sheffied Boot Camp, Victory Field and West Texas State School by the end of FY 09? Or will this simply provide Ms. Pope with an opportunity to threaten us all with losing our jobs if we don't conform totally to her vision of TYC?

    Hundreds of good, loyal, dedicated TYC employees will fall by the wayside before this is over and it's sad to say that it appears that our current executive administration could care less. If anyone bothers to look, neither of our the two tops execs as perfect as they have portrayed themselves to be.

    Not being a particularly religious person, I would have to ask just one last question...

    Thanks, Superior Staff. When discussion degenerate on some of these TYC threads I tend to just let things go because, as I've been repeatedly admonished, TYC folks have nowhere else to talk and the agency doesn't facilitate communication. (I've suggested before Ed Owens should start his own blog to inform staff and the public.) But I couldn't agree more with the above quoted statement and think other commenters should take it to heart.

    As I've said many times before, what y'all really need is a decent union. The attacks on one another are a poor substitute for banding together for mutual benefit, which at this point is what TYC employees need IMO more than anything. Youth and the public would be better off, too. Ignoring the only people with first-hand knowledge of what's happening is a sure-fire recipe for failure, and TYC employees can't make themselves heard if they're busy attacking one other.

    I don't mean don't report or root out corruption, but there are constructive and destructive ways to voice concerns, and IMO both ways are well represented on this comment string. best,

But I take my job seriously and my job is to monitor, supervise and protect the YOUTH in my care.NOT THE OTHER STAFF when they are doing bad things. I can't and won't shut my mouth about these abuse and neglect issues and I can personally say that it was so disgusting for me to see a 17 year old boy licking icing off of a 60 year old womans finger! It was like watching porn!!I hope that this is dealt with properly and I am going to make sure that its taken to the proper authorities to guarantee its resolved.I appreciate the fact that you let us come here and vent grits, you are right, we have no other outlet which is very sad.

  129. anon 9:48 - some things need clarification. First, while your job is to watch out for the youth, you can only do that if you watch out for the staff. That means making sure that staff are safe and that if anyone is doing anything to jeopardize safety, to report it. In fact, reporting wrongdoing, especially against the youth, is a legal requirement. You can be prosecuted for NOT reporting. Second, there are other outlets. One of the positive things that the previous administration did was to contract with an Employee Assistance Program called Alliance. You can get free counseling!!! I would suggest that if you are in so much distress, that you avail yourself of this service that is free to employees. You can find information about it on the TYC Intranet. Please call them.

I invite you to group up ALL of your employees, not just the one's you like and discuss with them one by one what needs to change there to make it a more unified setting to work in.Just witnessing the hostility and the animosity that exists in your facility is overwelming.You folks really need a good staff meeting or intervention to get you all back on the same page. I myself have worked in some miserable places, but I believe that you all have to take the award for being miserable at work. If this is just a view of what it is like in your workplace, personally, i would be looking for other employment or contact an outside agency to straighten it out.The EEOC and Texas Workforce Commission should be able to help.   158. It's a real shame to see McFadden reduced to such childish behaviors. When I was there, we ALL worked as a team. We were adult enough to work out our differences. The ranch was at one time held in very high regard, because of our integrity and teamwork. I had hoped that McFadden would not fall victim to the hypocracy flowing from the CO circus. After reading all of this, I'm afraid all hope is lost.
