alleges that the scent line-up was “rigged to be result-oriented, that is, to maliciously and intentionally implicate” [Calvin] Miller.“…The forensic protocol and methodology used by Defendants rendered the scent line-up not only unreliable but so tainted and cross-contaminated as to be consciously indifferent to the rights of Plaintiff,” the suit states. “Mr. Pikett, the supposed K-9 expert, advised and participated in every flawed procedure used.” The suit suggests those procedures in effect helped deny Miller’s 4th Amendment rights.
I'd never heard of scent lineups before recently, but this appears to be another forensic practice that's accepted by Texas criminal courts but has never been subjected to rigorous scientific scrutiny. DNA exonerated the latest defendant after Pikett's dogs accused him.
When ever you show the practices of eyewitness ID, dogs, voodoo, and tarot cards I always immediately think back to Salem and envision three little girls convulsing and saying "Doth Thou who has bewitched me..." The similarities are astonishing that over the course of 400 some odd years, we still rely heavily on "witch-tainted" blood to expose pacts with the devil. Makes me wonder why we as a society ever stopped blood-letting as cures for disease.

ReplyDeleteThis practice needs to stop and stop now. I wonder how many "K-9 hits" wind up up with the cops not finding anything during a search? Probably a lot because Texas cops will always "prompt" the dog so they can rip cars apart looking for dope.

No, probably not. Texas is rife with corruption (just google Texas and Corruption) on a level not seen since Edwin Edwards was Governor of Louisiana and the elder Daley was Mayor of Chicago. Most states would not begin to allow this crap to happen and then pretend like they dont understand it. Uniquely Texas and uniquely disturbing.
