Ultimately, it is too early to measure the impact of recent reforms on recidivism of youth on probation or exiting TYC, making it difficult to assess the success of the State’s investment in diversion and treatment. Sunset staff found that while the agencies have progressed, more work is needed and some time must elapse before reforms can be fully evaluated. Accordingly, staff concluded that TYC and TJPC should be continued for six years.They did say in the summary that:
While the agencies have implemented most of the required reforms, the juvenile justice system remains in transition and TYC needs to make additional improvements. As the youth population continues to decline, commitment costs and worker injury rates remain high. Staff turnover rates are down, but TYC continues to have difficulty staffing specialized treatment positions, and the agency can still improve the number of youth enrolling in and completing needed treatment.Overall, "TYC received about $262.4 million in revenue in fiscal year 2009. General revenue accounted for 86 percent of the agency’s total revenue. Other major sources of revenue included general obligation bonds, federal funds, and interagency contracts."
"The smaller population has resulted in excess physical capacity and a higher cost per youth per day," says Sunset staff, which has increased to $323.05 per day. Ouch. On one hand, the success at a legislatively directed policy to depopulate Texas youth prisons so rapidly is the direct cause of the high cost per day: The more youth diverted, the more the agency must pay per youth unless more facilities are closed. OTOH, if there are alternatives that counties could access for a lower cost, the high number provides more fuel for Sen. Whitmire's call to merge TYC with juvenile probation and close most remaining youth prisons.
The average length of parole supervision after leaving TYC is 10 months, Sunset found, with 3,714 youth on the agency's supervision rosters in FY 2009.
The Juvenile Probation Commission "received about $144.5 million in funding in fiscal year 2009. General Revenue accounted for 87 percent of the agency’s total revenue," according to Sunset. "In 2009, TJPC funding accounted for, on average, 26 percent of local probation departments’ operating budgets. However, the percent of a department’s budget provided by TJPC varied by county, from as little as 11 percent to as much as 97 percent. The agency funded departments through 19 separate grants, which are described in Appendix C."
TJPC's diversion grants aimed at keeping youth out of TYC received high praise for boosting reductions in commitments between 2009 and 2010:
- The 141 counties that received diversion funding reduced commitments by 32 percent.
- Counties that did not receive funding reduced commitments by 10 percent.
TJPC is already doing its first extensive, long-term evaluations of local probation programs, which I think is wise even if it renders no short-term benefit. "TJPC has begun a major data collection effort with the recent creation of a program registry. This registry will list all programs offered by local probation departments and allow comparisons between programs to evaluate program success. While TJPC has increased data collection efforts, it will likely be several years before enough data is available for meaningful analysis." That's fine with me; it's not like we're not going to need better data in several years.
At TYC, staffing remains a concern, particularly for positions requiring specialized skills:
One of the Youth Commission’s greatest staffing challenges has been high turnover rates, especially for positions providing direct care to youth. The agency’s overall turnover rate has dropped from 41 percent in fiscal year 2007 to 25 percent in fiscal year 2010. However, hiring the specialized treatment and education professionals TYC youth need remains challenging, especially at the Al Price State Juvenile Correctional Facility in Beaumont, the Corsicana Residential Treatment Center, the Crockett State School, and Evins Regional Juvenile Center in Edinburg. The Youth Commission reports that key substance abuse treatment positions at Al Price have been vacant for months, or more than a year in at least one case. Likewise, senior-level mental health positions at Evins were recently vacant for a significant period. Corsicana, which serves the youth with the most severe mental health needs, currently has five mental health provider vacancies, including the most senior position.Injuries to TYC staff remain a problem, whether as a result of understaffing or a lack of experienced and/or adequately trained staff: "In fiscal year 2010, TYC staff were injured at a rate more than double that of the next highest agency providing 24-hour care, the Texas Department of Aging and Disability Services, and four times the rate of the Texas Department of Criminal Justice (TDCJ)."
TYC has been shifting its treatment resources, as evidenced by a chart at the top of page 17. Fewer youth with identified chemical dependency needs are getting treatment, however nearly all youth identified with mental health needs receive treatment services. As a result, success rates for chemical dependency treatment have gone up while success rates for mental health treatment declined precipitously. Appendix B gives more unit-by-unit detail on "the number of TYC youth served in high- and moderate-intensity treatment programs in fiscal years 2009 and 2010."
Sunset recommends continuing the two agencies, for an annual total cost of $402.5 million at current funding levels, but with another Sunset review in just six years instead of the usual twelve, presumably to give recent reforms time to gel and for data to become available to measure problems or improvements.
Notably missing in the Sunset report were any issues raised by advocacy groups over the summer regarding TYC, with staff sticking tightly to their legislative charge from 2009.
Takeaway: TYC's base cost per youth remain high, ironically getting higher whenever TJPC and local probation departments succeed in diverting youth from state prisons. To cut costs long-term likely would require eliminating facilities to reduce overhead, something I wouldn't be surprised to see happen next spring. Criticisms of TJPC in the Sunset report weren't nearly as poignant as those of its sister agency and they probably feel pretty good about the result.

As far as TYC goes, one of the reasons cost is going up is because they are finally getting around to providing the staffing they need. At Al Price, education staff have just started reaching the levels required by law, and now have on board some extremely talented people. And, student performance is starting to reflect it.
Of course, I fully expect TYC Austin administration to shoot itself in the foot again and do something stupid to cause performance to drop.
What a problem...you have to be more of an optimist than I am to think that a ready correction is achievable in our lifetime.
Just as adult corrections needs more vocational and life skills training, Juvie needs emphasis on education and behavioral therapy. Both need changes in society and the legal system to allow released offenders to find appropriate work. A felony conviction is still the kiss of death for most job seekers except for forms of day labor. It breaks my heart almost every day to hear young offenders talking about how well they are going to do in a reasonable job upon release, while I know full well that they will be lucky to find something at minimum wage with no benefits.
Please don't bemoan the lack of mental health services--in this day and time that mainly consists of starting patients on costly and toxic medications which immediately lead to drug recidivism upon release in virtually all cases. It's a rare offender that violates parole due to untreated major mental illness; as the psychiatrist Thomas Szasz writes,they aren't mentally ill, they have problems with living. As a medical student I thought that was heresy; now older and wiser, I believe it more and more.
Advocacy groups have their hearts in the right place but unfortunately their brains are not engaged; they are long on complaints but short on meaningful suggestions other than "dope them up and let them out".

I am one of the advocates mentioned and I take issue with the commentator who finds we lack brains or solutions. While there are some who want kids to be doped up and let out the majority of us want to see meaningful change in the child in the hope they will move on to a more respectful life. Just doping a kid up does not do this.
I became an advocate four years ago when my son was incarcerated for the murder of his own sister. In this time I have fought many battles with TYC on behalf of all the kids, and families, in the system. None of those battles have to do with the realeasing of an obviously mentally ill child into society unless that child has shown the capacity for remorse and the ability to change. I spend all my energies on advocating for better specialized treatment based on case files, police reports, AND scientific psychological testing, something TYC does not do. I also advocate tirelessly for the role of the family in treatment. Children do not commit crimes in a vacuum and if they are going to get better the family needs to be involved. I also advocate for penal code reform because much of what our kids do has been criminalized instead of being viewed as a mental health or addiction issue, which it most often is with children.
Many advocates have a personal interest in the system and to many that may make us 'brainless'. We have years of combined experience, the majority of us are very well educated, and we have a passion and commitment to a cause most people think of as worthless. You could not be more wrong about advocates. We are the heart of the movement but our brains work just fine too.
I don’t think you people get it. As an alumnus I’m disgusted at what has become of my alma mater over the last 3 decades. It doesn’t take a rocket scientist doing research to see this pathetic trend. Searching for articles on tyc in the news papers of our state’s major cities shows a trend over the last 50 years of physical abuse diffusing into sexual abuse in the 90’s. Culminating with a hard fought, deep cover up, scandal that actually got a Chester convicted. I have contact with about 30 alumni ranging in age from their late teens to early 30’s who all tell the same disgusting stories about staff, mostly playas, sexually molesting kids on their dorm. Reporting it is a joke, because all state boys lie, according to tyc emps. The stories the Gatesville alumni tell, is far different than what more recent alumni tell. Researching state archives one can easily find the recidivisms rate increase from an average of 20% in the 50’,60’s and 70’s and increasing to above 80% today. The tyc culture went from a self sufficient model in the 50’s and 60’s, to a cost effective model in the 70’s then in the 80’s began its exponentially growing cost model to the embarrassing cost prohibitive model in place today, 323.05/day.
High school years are very formidable years for kids, even thugs. Many things I learned at Terrace, and habits I picked up during that time, some of which I had to overcome but others have given me an advantage over the average citizen. Skill sets that have led many successful endeavors, that can be read about in a book I’m writing called, “tyc and ME”. I have become very concerned about the kids who have been subjected to tyc and want to help them break free of the bondage that the system has on them. I believe I have a lot to offer, I’ve been through the volunteer training, and after visiting several campus, in a roundabout way been told I’m disqualified from volunteering because I have felonies. That is incorrect, I have no felonies. I’ve been told the kids out on parole need clothes and toiletries, but after organizing a drive to collect these items, I can’t get my phone calls returned. I have access to people who could provide jobs as well as a family business that employs over 600 people with a history of hiring ex convicts. Again, I can’t get anyone at tyc to return my calls. I have people who want to mentor kids, some tyc alumni, still tyc not interested.
On a previous post one of the typical anonymous tyc bloggers wrote tyc monitors this blog and it could have something to do with what I write. I hope that’s not the case. I can understand some night shift worker in-between boys anonymously blogging defensive criticisms, but I would think the CO crowd is too busy molesting state funds and lording over superintendent to monitor what I write. However if that’s the case, it’s safe to assume that the Chester/protector culture does not want anyone who openly disrespects pedophiles out of fear I would snitch them off.
Everything I say/write regarding tyc is documented public knowledge. I wish this was all made up, but I don’t think the porn industry could come up with the pathetic disgusting things tyc does to many of its charges. The tyc would rather downplay all of this, cover it up, and be defensive. They don’t want to talk about Morales v turdman, it’s even downplayed in there emp training let alone their current culture of child predator and those who cover for them, Chester/protector culture.

I don’t think some of you get it, especially you people currently at tyc. High school years are very formidable years for kids; mine were spent in your agencies care. I learned things and grew in your world, Terrace dorm 4; some things I had to overcome other things have given me an advantage over the average citizen.
In Texas, the religious right wingers tend to use judgmental stigmatization of social problems through criminalization with an overall effect to punish by humiliation. The tyc corporal punishment of bygone days was to humiliate not punish, same as today’s tyc use of other forms of abuse. The verbal, mental, academic and sexual abuse is to humiliate the kids, no longer leaving short term physical marks but leaving deep lasting emotional marks.
The book I’m working on entitled, “ME and tyc” is about how to overcome the effects of tyc. The new web site is to draw together resources that can help these kid break free of the system. The social media blitz is to draw attention to the web site sensationalizing what people already know about our state 120 year old state agency for child abuse. A safe place for pedofile to work with an ample supply of unwanted children to abuse.

An average of 87% over the last decade of young men released from tyc and either returned to tyc or sent to tdjc within 2 years from their release. The data, I’m told, was accumulated from both tdjc and tyc intake data. It’s actually slightly higher if you just look at the last 5 years.
The tyc could be compared to a drug addict who does not want to get off the dope, no matter who tries to intervene, or what methodologies are implemented. The drug addict refuses to take responsibility for their depraved state of being and accept the help they so desperately need to clean themselves up and make better their lives and the lives of the people around them. Until the drug addict can accept responsibility, stop defending themselves and dumping their issues on others, can the drug addict be healed from their addictions and become a productive member of society.
Unlike the drug addict It’s my understanding that the pedophile cannot be helped, their appetite for molesting others especially weaker children can never be satiated. The pedophile will always be defensive and will not take responsibility for their actions. I just got back from a trip to Gatesville to visit the state school exhibit where I actually got to read the Morales v turdman indictment or suit. I’ve heard about the suit since I was 15 years old and finely got to see the document that started all the bs up to today. I think it was Kendrick’s copy since Kendrick’s family donated a bunch of stuff to the museum. I heard turdmans copy was all marked up in self defense rhetoric. Great pic of Kendrick, Morris, and Sneed on the opening day of Mountain View. The three stooges of MVSSB. Mack O Morris is notorious about beating state boys, it’s how he got promoted. There’s a great eye witness story on the Gatesville blog about one of Morris shenanigans involving sour milk on the cereal at Hilltop. Very similar in today’s tyc, molest a state boy and you get promoted, like tyc’s chester brookins. It’s probably safe to assume that anyone running anything and/or that’s been transferred around in tyc most likely got their position by molesting state property.

I informed her I have done a time line research that would suggest tyc’s fall into state sponsored pedophilia could be linked to fall out from affirmative action hiring policies. I did the research and picked up on this, while her and so many like her saw it play out in real life. From Gatesville to San Saba, to Mart. I let her know that since moving from the disciplinarian environment to the love fest environment, recidivism sky rocketed. She wasn’t surprised, said even the staff is counting now. She recently visited a tyc facility as a volunteer and noticed the matrons all dressed like ladies of the night. Said it was disgusting and blamed tyc’s fall into depravity on “the state being forced to hire all them schvartzes”. Well she actually used the N word like the kids on the train use for schvartzes. I informed her I have done a time line research that would suggest tyc’s fall into state sponsored pedophilia could be linked to fall out from affirmative action hiring policies. I did the research and picked up on this, while her and so many like her saw it play out in real life. From Gatesville to San Saba, to Mart. I let her know that since moving from the disciplinarian environment to the love fest environment, recidivism sky rocketed. She wasn’t surprised, said even the staff is counting now. I let her know the count system is no longer in effect and that the staff naturally spoke state talk, or ghetto as it’s called now.
All in all it was a fun conversation, and a reminder of what a different world Gatesville and tyc is. How foolish could a person be to discuss tyc without ever having spent time in its world? Child advocates, parents, even lawyers have battled tyc for decades with little results. M v t obviously made things worst coupled with other government policy’s. I think it’s going to take alumni and former employees to bring these tyc bustards down. One can only imagine how deep the cover up is and how far back it goes.
